Back in April of 2011 I was arrest for felony grand Theft 2nd degree, this situation arose from a bad business partnership that I had gotten involved with back in 2007 had gone really bad and I got left holding the bag, and a serious felony grand theft charge too boot, I had to use a public defender ...
Ben was charged with a serious white collar crime related Grand Theft that carried a maximum punishment of 15 years in prison. He was wrongfully accused of stealing money from a client of his. As with all theft cases the prosecution HAD to prove intent to commit the theft. It was clear from the beginning that he never had the intent to commit any theft and the prosecution could not prove he had the intent. In simple terms, the strategy in this case was to methodically smash the prosecutions case in two-parts: 1) destroying the prosecutions case through the use of deliberately scheduled discovery depositions and 2) strengthening Ben's case by bringing forth our own evidence. The depositions of the prosecutions witnesses, each one more involved in the case than the last, revealed that none of the prosecutions witnesses could prove that Ben had the intent to commit any theft. Our own evidence came in the form of a witness, Ben's accountant, who was able to explain, during a deposition conducted by the prosecution, what happened to the alleged "stolen" money. After the discovery process was finished it was crystal clear to me that we would win the case at a trial and I immediately demanded a speedy trial to ensure that Ben would obtain justice as soon as the law would allow. The prosecution, having seen the case crumble apart during discovery, had no choice but to drop charges against Ben.

This gentleman was charged with three felony counts: 2 counts of Possession of a Firearm by a Convicted Felon and 1 count of Possession of Ammunition by a Convicted Felon. He was facing a maximum 3 years in prison on each count. He had no "legal" defense to the charges. However, because of sloppy representation by his prior counsel at the plea hearing which made him a convicted felon, this gentleman was never informed by his lawyer that he became a convicted felon and that he could not be in possession of any firearms. Moreover, this client is an excellent and upstanding member of the community. By filing a PC 1385 Motion to Dismiss I was able to convince the prosecutor and judge that my client did not deserve to be charged with a felony based upon his excellent character and his prior lack of an effective attorney. Based upon the 1385 motion and my advocacy the district attorney offered to dismiss two of the counts and to change the remaining Possession of a Firearm by a Convicted Felon count to a misdemeanor with three years of non-reporting probation. The court accepted the plea offer and the court also agreed to waive all fines and court fees. This was an excellent outcome given the lack of any legal defense. While on summary probation this man is free to travel and does not have to report to any probation officer. He just has to keep his nose clean. Before his 3 years of probation is up, he can file to an early termination of probation and can also move to expunge his prior criminal history. Truly a great outcome for a great person.

Well, he got me off!
My case was very straight forward, in my opinion, but I was facing some serious consequences. Mr. Pamintuan met with me in the jail and explained to me what was going on and what I was facing. This client of mine benefited, justly, from Florida's controversial "stand your ground" law. The main reason his case took so long to resolve was because of difficultly with the man who assault him and another state "witness". In addition, because a defense witness was out of town for an extended period of time we had to wait until the witness was in South Florida in order to perpetuate his testimony. This client was excellent in providing me with information which I used to investigate, prepare his case and have his case dismissed.

This case was bound to go to trial from the beginning because Mr. Mitchell was innocent and had a great defense. I knew from the beginning that it was imperative that I prepare Mr. Mitchell and his defense witness to testify in front of a jury right from the get go.
