Saved my RN License

This client was truly charged with a "wrong place, at the wrong time" type of crime. In order to protect this client's identity, I will not state any specifics about the charges but, I can say that this client did not act intentionally. As stated above, this client is a registered nurse and a conviction would have required him to report the conviction to the Board of Nursing, which would have resulted in an investigation by the Board of Nursing and possible suspension of the client's RN license. Therefore, it was of upmost importance to come to a resolution which did not result in a conviction. After extensive negotiation with the prosecution (who at first wanted to convict my client) I was able to come to an agreement with them which would result in an eventual dismissal of the charges against my client after 1 year (a deferred prosecution) provided he pay a fine, complete community service hours and attend a one day education course related to the crime he was charged with. In the end, the client did not have to admit guilt or even plea "no contest" to the crime he was charged with and will obtain a dismissal of the charges after he completes the requirements and does not get rearrested during the 1 year of deferred prosecution. Most importantly, we were able to preserve his RN license.

Motion for reconsideration to reduce restitution monthly payment .
Atty Ed Pamintuan performed an excellent job in resolving my case in court to reduce monthly payment.I highly recommend him as a very good criminal defense lawyer.
Lorenzo was ordered by the court to pay criminal restitution to a victim during the course of his 3 year probation for a misdemeanor crime to which he admitted guilt. He was informed by the court to report to court collections so that his ability to pay could be assessed in order for court collections to calculate a monthly restitution payment. Court collections assessed his ability to pay but ignored certain monthly expense obligations which resulted in a monthly restitution payment that was beyond his ability to pay. The assessment was unfair and unreasonable and would eventually require Lorenzo to borrow money to pay the monthly payment or else suffer a violation of his probation and of the order to pay the restitution. I was able to convince the court to order court collections to reassess Lorenzo's ability to pay taking into account the monthly expense obligations that they had previously ignored. Court collections reassessed the client's ability to pay and lowered the amount of monthly restitution by $300 for the entire course of his 3 year probation (5 years if his probation is later extended) allowing him to pay back the restitution at a monthly rate that is within his means.

The police officer who arrested Dan violated his constitutional rights. With out probable cause, the officer stopped the vehicle Dan was driving while he was leaving a gas station parking lot and ordered Dan to exit the vehicle. Although one of Dan's passengers had littered from inside of the car the police officer did not have the authority to stop Dan and order him to step out of the car. Dan, who was scared and under the impression that he could not resist the commands of officer because of the officers illegal show of authority, gave the police officer consent to search the vehicle he was driving. The police officer found contraband in the vehicle (which did not belong to Dan) and arrested Dan. I filed a motion to suppress evidence and argued that the police officer violated Dan's constitutional rights when he commanded Dan to stop the car and exit the vehicle without having seen Dan's commit any violation of the law. The court agreed with my arguments and the prosecution was forced to dismiss Dan's case. Some people might say that Dan's case was dismissed because of a legal "technicality" however I would argue that Dan's case is a sad story of profiling by a police officer who abused his power that happened to have a happy ending. Most police officers are good people who do a good job protecting us but there are a few bad apples who give good cops a bad name. I'm glad that I made sure that Dan did not become a victim of this bad cop.

This gentleman's sister was arrested for alleged felony domestic violence. Ferdinand contacted me the day after his sister was arrested and informed me that his sister was innocent of the charges. It was a good thing that he contacted me so quickly after the arrest because charges had not yet been filed against his sister, which gave us a chance to convince the District Attorney to "no action" her case before charges are formally filed. It is often times less difficult to convince the D.A. to "no action" a case before charges are filed than to obtain a "dismissal" after charges are filed. The alleged victim signed a declaration that explained the incident and informed the D.A. that he did not want charges to be filed and that if charges were filed he would not testify against his wife. Hours after I provided the declaration to the D.A. Family Protection Unit and the Police Department Family Protection Unit the case was rejected by the D.A.'s office and Ferdinand's sister was released from jail without bail. She is now back to her everyday life and avoided any adverse consequences with regard to her immigration status in the United States.
