Motion for reconsideration to reduce restitution monthly payment .
Atty Ed Pamintuan performed an excellent job in resolving my case in court to reduce monthly payment.I highly recommend him as a very good criminal defense lawyer.
Lorenzo was ordered by the court to pay criminal restitution to a victim during the course of his 3 year probation for a misdemeanor crime to which he admitted guilt. He was informed by the court to report to court collections so that his ability to pay could be assessed in order for court collections to calculate a monthly restitution payment. Court collections assessed his ability to pay but ignored certain monthly expense obligations which resulted in a monthly restitution payment that was beyond his ability to pay. The assessment was unfair and unreasonable and would eventually require Lorenzo to borrow money to pay the monthly payment or else suffer a violation of his probation and of the order to pay the restitution. I was able to convince the court to order court collections to reassess Lorenzo's ability to pay taking into account the monthly expense obligations that they had previously ignored. Court collections reassessed the client's ability to pay and lowered the amount of monthly restitution by $300 for the entire course of his 3 year probation (5 years if his probation is later extended) allowing him to pay back the restitution at a monthly rate that is within his means.

This gentleman found himself in a bad financial situation after he became unable to pay off debt he incurred as the result of a failed business venture. To compound an already stressful situation he experienced collection efforts that went above and beyond normal collection efforts, including home visits to collect on the debt. After filing for bankruptcy, all creditors were put on notice that all collection efforts had to cease and that any violation of the "automatic stay" on debt collections would result in a request for sanctions by the bankruptcy court. The collection efforts stopped reducing the client's stress and anxiety regarding his financial situation. The bankruptcy court granted Ron a full discharge of his debts which has given him a "fresh start" after much distress over his financial situation. I was very glad to be able to help him with his financial troubles.

From the outset of Edward's case his insurance company had provided him poor service; shortchanging him on his property damage claim. I was intent on making sure that his insurance company made good on their promise to insure that he be made whole with regards to his bodily injury claim. Edward was badly injured by a driver who did not have any auto insurance. It was a good thing that Edward had excellent Uninsured Motorist Coverage through his own insurance company. Initially, Edward's insurance company tried to deny his Uninsured Motorist demand, claiming that because there was no actual physical contact between Edward's vehicle and the at-fault driver's vehicle that Uninsured Motorist Coverage was not triggered. However, the insurance company quickly changed it's position when it's lawyers reviewed a memorandum I sent summarizing case law, statutory law and the insurance companies own policy manual regarding Uninsured Motorist Coverage. In my letter I put the insurance company on notice that Edward had a valid Uninsured Motorist Claim and that if they not agree we would demand binding arbitration to ensure that Edward received fair and just compensation for his injuries and pain and suffering. The insurance company agreed that actual physical contact is not required to trigger Uninsured Motorist Coverage when the identity of the uninsured at-fault driver is known. I was able to negotiate a settlement with the insurance company which paid all of Edward's medical bills and justly compensated him for his pain and suffering. The most important thing is that Edward is on his way to fully recovering and can now put this horrible accident behind him.

The police officer who arrested Dan violated his constitutional rights. With out probable cause, the officer stopped the vehicle Dan was driving while he was leaving a gas station parking lot and ordered Dan to exit the vehicle. Although one of Dan's passengers had littered from inside of the car the police officer did not have the authority to stop Dan and order him to step out of the car. Dan, who was scared and under the impression that he could not resist the commands of officer because of the officers illegal show of authority, gave the police officer consent to search the vehicle he was driving. The police officer found contraband in the vehicle (which did not belong to Dan) and arrested Dan. I filed a motion to suppress evidence and argued that the police officer violated Dan's constitutional rights when he commanded Dan to stop the car and exit the vehicle without having seen Dan's commit any violation of the law. The court agreed with my arguments and the prosecution was forced to dismiss Dan's case. Some people might say that Dan's case was dismissed because of a legal "technicality" however I would argue that Dan's case is a sad story of profiling by a police officer who abused his power that happened to have a happy ending. Most police officers are good people who do a good job protecting us but there are a few bad apples who give good cops a bad name. I'm glad that I made sure that Dan did not become a victim of this bad cop.

Chito was arrested for and charged with DUI with a blood-alcohol level over .20. This was his first ever DUI. In San Diego, anyone who is charged with a DUI with a blood-alcohol level over .20 is usually looking at having to attend an expensive 9 month DUI First Offender Class that costs over $1100 dollars and perform 10 DAYS public work service. In additon, in above .20 cases, the court may consider additional penalty enhancements. In Chito's case, I was able to negotiate a stipulated plea bargain, the stipulation being that the D.A. would sentence him as if his blood alcohol level was .19 instead of .20. Although Chito was still charged with DUI he did not have to attend a 9 month DUI Class and did not have to perform 10 days public work service. Instead, he was ordered to attend the standard 3 month DUI First Offender Class and perform 5 days public work service. This outcome saved him hundreds of dollars in fees and lost wages. This gentleman was deserving of a break and I am glad that I was able to negotiate a good deal for him.
