Bait and Switch sale
I was sold the process initially and went through paperwork and procedures but I was rarely personally advised where we were heading. My outcome was not favorable and I am still trying to finalize my divorce. Initial meeting was fine and I never saw Berner thereafter and if so, an immediate request...
I have never had a client named “Garner”—not first name or last name. If you are truly a former client, kindly identify yourself truthfully and completely so that I can fully respond for the target audience you have selected about what the circumstances of your case were/are. You have “opened the door” with your post, thus authorizing me to make disclosures about your case. Are you even a former client? I did have an opposing party recently whose name is Garner (different than my client’s) and, if that’s you, I guess I’m flattered that I angered you to such an extent through the course of aggressively representing my client that you sought to retaliate against me through a fraudulent online posting, though it’s still actionable on my part (libel, defamation). Regardless of who you are (opposing party, disgruntled former client who we had to say goodbye to for breaching their contract with our office, lonely competing attorney, etc.), I respond as follows: We pride ourselves in being overly communicative at this office for multiple reasons (client satisfaction, remaining on the same page as the client, protecting the client’s case and our reputation, etc.). This is confirmed by the multitude of positive reviews of my services on this site alone. We even go so far as to draw a detailed, step-by-step roadmap for/with the client at the outset of representation in order to get on the same page as the client, and so that there can never be a question later on about having explained anything to the client about the process. I know of no other local firm that does that (though it’s a no-brainer) based on having heard from hundreds of clients over the years who have left other firms during active litigation to hire my office to “pick up the pieces”. Accordingly, your comment about being “rarely personally advised about where we were heading” is not only confusing (i.e., personally, as opposed to impersonally?) but is also contradicted by our office policy. You next state your “outcome” was not favorable, implying we were somehow ineffective as to the outcome of your divorce case and the outcome was not your voluntary decision (i.e., voluntary settlement which only the client has ultimate control over—not the attorney). In the context of a divorce case, that can only mean that there was a trial and the Court issued what you deemed to be an unfavorable ruling. However, you then state you’re still trying to finalize your divorce, which appears to contradict that, and I have had no cases like that, regardless. As for your comment about payment, we would not have requested payment unless payment was already owed for services already rendered, which we should not have to ask for more than once. We work hard for our clients. We expect to be paid for it when payment is due just like any employee would—just like you. You are basically admitting that you were breaching your own agreement with our office if such a request for payment was actually made, as you say. As for alleged lack of compassion and “Bait and Switch”, we truly treat our clients’ cases as if they were our own and all that that entails, and I am fortunate enough to not be a sole practitioner and to have a great team working alongside me (as made clear by the name of the firm, Berner LAW GROUP, PLLC) though I still oversee everything on a daily basis. Furthermore, our client agreements that are signed at the outset of representation clearly state that attorneys (plural) and paralegals will be involved in working the case. The results from me and the rest of the GROUP (as confirmed by almost all of the posters on this site) speak for themselves. Based on your comments at least, which I have rebutted, you could not be a former client of mine. Again, if you are truly a former client, please identify yourself fully so that I can respond even more comprehensively about your particular case circumstances and the truthfulness of your allegations.
