Sean Olender is a State Bar certified specialist in immigration and nationality law. As of late 2022, there are only four other certified specialists in immigration and nationality law in Santa Clara County and one other in Santa Cruz and Monterey Counties. You can reach Sean's office in San Jose at and in Santa Cruz. For timely and interesting articles on important immigration and employment law topics, visit.
California attorneys who are certified as specialists have taken and passed a written examination in their specialty field, demonstrated a high level of experience in the specialty field, fulfilled ongoing education requirements and have been favorably evaluated by other attorneys and judges familiar with their work. The one day examination includes four hours to complete eight essays and 2.5 hours to complete 75 multiple choice questions. The examination is difficult because it may test on any immigration law question from labor certification and EB-5 investor visas to deportation defense, the immigration consequences of criminal convictions... anything.
Sean also served as an adjunct professor of law at the University of San Diego School of law from 2012 to 2015 where he taught a three unit upper division class on immigration law.
Sean has practiced immigration law for more than 17 years and has experience in all areas of immigration law from business immigration, H-1Bs, EB-5, PERM labor certification to J-1 waivers, unlawful presence waivers, cancellation of removal, family immigration, asylum, withholding of removal, circuit court appeals, mandamus, parole-in-place, humanitarian parole, DACA, and many other areas.
Olender has a paperless office with superb systems to streamline case processing and reduce data processing errors.
Sean Olender also practices employment law and has represented both employees and employers in employment litigation areas including wage and hour disputes, sexual harassment, age discrimination, race discrimination, retaliation and whistleblowers. Sean has found that employment law complements immigration law because many immigration law issues have employment law issues and vice versa. Often individual and corporate customers have questions or problems that involve both immigration and employment law issues and Sean brings together knowledge of both to offer wholesome solutions to difficult problems.

Unprofessional
I hired Mr. Olender and and only took one time to realize that I had to fire him. Although it does appears that Mr. Olender does know immigration law, as I client I felt insulted by him and did not feel the need to hear profanity coming out of my attorney. Not to mention making fun of my wife's curre...
I calculated a path for this client's wife to obtain US residence that required quick action because she is in deportation proceedings. This required filing an I-130 petition and an I-601A waiver of inadmissibility and also asking the judge to place the case on the status calendar to allow time for USCIS to adjudicate the I-130 and I-601A. I took this client's wife's legal situation very seriously as I take all clients' legal matters. I expressed disappointment when this client failed to take his own wife's very serious situation more seriously. This man's wife faces deportation to a dangerous country where she's afraid to return. She doesn't qualify for refugee-type protection. I agreed to charge him less than 50% of the market rate and provided a generous payment plan. I emailed him a draft contract on October 4, 2018. Two months later, he claimed he "lost" the e-mail and contract. He asked me to resend it even though his request responded to the same email he said he lost. After he paid his deposit late, he never paid again. He never called or e-mailed to ask me my thoughts. Months later, he claimed he couldn't pay the filing fees and asked if USCIS accepts payments. I said no. I offered to wait even longer for him to pay me so he could pay the filing fees. I prepared petitions for his wife and stepchild, reviewed documents and emailed draft petition forms to him. He still insisted he couldn't pay the filing fees "without borrowing money" which he did not "want" to do. Apparently, the burden of borrowing money exceeded his concern over his wife's deportation and physical harm. Though he still failed to make payments to me and the I-130 petitions were not filed for lack of filing fees, I still attended his wife's Immigration Court hearing in San Francisco. I was concerned about her situation. I told the client what I thought, so he posted this review.
