Bankruptcy is never a fun process. The first attorney with whom we met made it substantially worse, letting my wife and I know that we would never qualify for chapter 7 -- even though he couldn't even be bothered to look at the documentation we brought with us to our initial consultation -- and that ...he would not take us on as clients if we didn't accept that simple fact. Let me start by saying something I believe we can all agree...life doesn't come with a user manual with easy to follow instructions, especially with money. We grow-up, are never really taught anything about how money is meant to be saved as well as spent and because most of us forget about the passb...ook savings account we typically are all taught to start out with (beyond the piggy-bank that is), it’s clear that we don't even know how to use money. When we have to take a crash course, is typically when we find ourselves drowning in debt; and not always due to our own inability to save but our lack of knowledge of things like "interest rates" or "taxes" or "repayment terms of a student loan". What I can say is that I’m not responsible for what I haven’t been taught, that the banks charge you lots of money to use credit cards and just not tell you up-front how much it really costs you to use that plastic card and that if you lose your job, no one really cares how you’re going to make ends meet; you’ll just have to be smart enough to know and live in a manner that is below your means of supporting yourself (Suze Orman’s advice of “live on ½ your income and save ½ your income is the mantra, but difficult for anyone who is single, especially). But, when it came time for me to learn was when I found myself in 3x’s my annual salary in DEBT and interest compounding on this debt by the day, and banks not willing to work with me on payment plans, even when I considered debt management. After reviewing all of my options, I decided to file bankruptcy. And although I could have gone it alone, I decided to look at an attorney who, depending on cost and intellect, might make the painful decision, less so. And believe me I shopped for counsel and I didn’t hire the first 2 people I met with who appeared on paper to be capable and smart.
