Depending on the victim’s sustained injuries, a Domestic Violence case may be charged as a misdemeanor or a felony. If the injuries are minor, the case will likely be filed as a misdemeanor. If the injuries are serious however, it will likely be filed as a felony. Irrespective of whether the matter is filed as a misdemeanor or a felony, if a defendant is found guilty/pleads guilty to Domestic Violence, he/she must complete a 52-wk batterer’s treatment prgm, along with community service & fines.

When a person under 18 years of age commits a crime, the juvenile courts have jurisdiction over him/her. It is important to note that juveniles do not have a right to bail. During the first appearance/Detention Hearing, the child and at least one parent must appear. The child will be informed about the charging document and advised of his/her rights. If the crime is egregious, he/she could be remanded into the custody of the Probation Department, or even charged as an adult.
