As I learned during my trial, dependency law requires a very distinct and different set of skills in comparison to normal family law. First of all, the stakes are immensely higher: dependency courts can strip a parent permanently of the rights to custody and unsupervised visitations merely based on a “preponderance of evidence.” While judgements in family court can be revisited and amended with good cause, a ruling in dependency court can have a lasting and irredeemable impact on a minor by removing a parent indefinetely from a child’s life. Court proceedings in dependency court are also far more intricate and complex, which is why parties are offered public defenders as if they were defendants in criminal court. There’s a reason why there are over 1500 regular family law attorneys in Los Angeles, but only a dozen or so specialists in dependency law. In my case, four parties appeared in front of the judge: D.C.F.S. counsel, minor’s counsel, opposing party’s counsel, and Ms. Fung representing me. Navigating a trial with that many parties requires rare legal skills that Ms. Fung exhibited with astonishing aplomb: examining and assessing an array of submitted evidence, questioning witnesses, and conducting cross-examinations of social workers, mental health professionals, and potentially law enforcement officers. Ms. Fung has over 23 years of experience as an attorney practicing dependency law, and that proficiency was an invaluable asset in my case. She appeared to be familiar with all the judges of the courthouse in Monterey Park and knew all three attorneys of the opposing party through personal experience. Ms. Fung also showed an uncanny ability to read the flow of the proceedings on each of the ten court days of my trial. She elicited inconsistencies and weak spots when questioning witnesses, and at two pivotal moments during the trial she caught the opposing parties flat-footed when successfully tabling motions. Her closing argument, lasting 40 minutes, was a masterpiece. In addition to her deep knowledge of the law and vast experience in procedural matters, Ms. Fung represented me diligently and extremely well-prepared. It was apparent to me that she had familiarized herself extensively with the vast amount of evidence, had researched witnesses’ backgrounds, and had devised a narrow yet ultimately highly effective strategy for my defence. Ms. Fung’s manner was always warm and professional, composed and unflappable. In front of the judge, she always spoke freely, with great deliberation and authority while showing due respect to the court, all of which was well received by the judge. If you should find yourself in the unfortunate situation of facing a case in Los Angeles dependency court, you definitely would not want Ms. Fung to oppose you — you’d want her by your side fighting your case. If I could give Ms. Beatrice K. Fung, Esq., a rating of a hundred stars rather than five, I would do so without hesitation.
