A settlement was reached in which defendant pleaded guilty to a reduced charge of 2nd degree homicide with remaining charges dismissed. More importantly, the judge recommended that defendant should serve no more than 5 years in prison.
The charge of negligent homicide was dismissed. No jail was imposed. To avoid trial, the midwife pleaded "no contest" to unlawful conduct and reckless endangerment, as misdemeanors.
All 19 counts of Communications Fraud were dismissed.
