Poor attention to details Gross oversight

I hired and paid Attorney Marc Stewart to address my malpractice case. He said he used an expert witness but despite using an expert witness and reviewing the records neither noticed that the correct x-ray imaging was not taken to diagnose what was most likely the cause of my pain and disability base...d on the history and symptoms. This failure to diagnose and take the proper imaging by the surgeon would probably have been enough to have a case but Mr. Stewart and his expert didn't even realize that the correct imaging was not used when I went to see the surgeon at the 3-month mark still with constant pain and needing narcotics and unable to turn my head or look down since the surgery three months earlier. The surgeon only took a basic X-ray and said everything was fine when it wasn't. And instead of getting a diagnosis and follow up correction surgery I was on narcotics and other pain chemicals (medications) for 5 years in constant pain, and suicidal. And lost my career and ability to work in my profession. Mr Stewart's failure led to the two-year statute of limitations expiring and preventing me from being able to have a case. And receive compensation for damages from the surgeon. And to stop suffering much sooner instead of 5 years of constant pain and suffering.

Amazing Customer Service!

I highly recommend if you appreciate being treated with extraordinary hospitality, empathy, and respect. Also, they are very punctual in their return contact. The best consult one could possibly hope for, and I am thankful!

Consultation DEFINITELY NOT FREE

He charged me $650.00 to tell me that I didn't have a case. How can he say free consultation on his web site? AND he never even met me in person. Just phone calls despite me going to his office 2-3 times to drop off documents. I would recommend not calling a lawyer in or near the city of the medical... provider. They probably know each other. He never even reviewed the surgeon's office notes where the surgeon noted numbness and weakness in fingers that correspond to the level below the one that was operated on in my cervical spine. He never commented on this because he never reviewed the surgeon's office notes where on the initial visit the surgeon wrote my symptoms which correspond to the level below the one the surgeon operated on. Specifically numbness in the ring finger and small finger which corresponds to cervical spine level C7-T1 and not C6-7 which was operated on and fused. Nothing in the surgeons exam corresponded to the level operated on. MRIs at 6 months and 1 1/2 years after the surgery show equal or worse pathology at the level below the one operated on as well as severe compression of nerves at the level operated on which was supposed to be corrected). I'll probably be on narcotics the rest of my life and spend hours a day lying on my back either waiting for the narcotics to start working or recovering from the strain of just being upright.

We are disappointed that you are not fully satisfied with the service we provided, but we decline to sue doctors without strong proof of malpractice. Most people see this as reasonable and fair. Our firm extended great time and effort to provide you a thorough analysis of medical records, a detailed written summary of findings, and a good deal of personal time on the phone with you. The $650 was for an extended level of service which was offered and accepted by you. We cannot and will not provide an upfront guarantee that a meritorious claim exists before conducting an investigation. The evidence and the law will always be our guide. We do understand that you have suffered a serious medical hardship, and for that we are truly sorry. However, our attention must be narrowly focused on whether or not legal liability exists and if it could be clearly proven. Lastly, I always decline to review cases if I have a conflict of interest (like personally knowing the doctor that is subject to an investigation). I also disclose that conflict upfront & suggest names of other experienced counsel.

Marc and his staff are wonderful people. He was professional during the case, but most of all he seemed very sincere. Even after all these years (10 yrs), they have returned most precious pictures of my dad and the family, that I had forgotten about. Thank you for your help and your kindness!
