Better off with a Dead Johnny Cochran as your Attorney

Magically gets 5-star reviews after every negative one. I contacted this attorney to help me on my employment case. A Judge found out I had court-martial convictions and had his deputies make a false report that I called him in order to disclose these. Turns out my employer (The County) knew about ...the convictions when they hired me. I was still fired for not reporting a “felony” and not cooperating in their investigation. The investigators claimed I told them I was “unsure or unaware of my discharge from the military”. To my favor, the investigator’s notes stated they were told I had a “punitive discharge” from 2004-2008. I was fired without much explanation and filed an appeal to the full board. So, I hired him just to help me with the cooperation charge before the Board. The other charges I locked up myself. He calls me and talks a big game. I pay him, the next time we meet he sings a different tune. He starts to tell me I shouldn’t do anything to ruin the appeal (ironic as you’ll see below), so I shouldn’t testify. Basically, he’s telling me we are going to lose. This is of course after I paid him. Keith calls me the day before the hearing and tells me he agreed to stipulate some facts and waive an issue that I didn’t receive notice (an email) for the cooperation charge. He also said he was stipulating I was previously found guilty of X and Y. I asked him to clarify what I was found guilty of, he said he’d get back to me. Never did. The next day I meet him, he doesn’t make eye contact with me and starts acting shady. Tells me he doesn’t even want me present at my own hearing and will ask the Board if I could be excused. My best guess is he did not want me called as a witness by the otherside, which would have been a good thing. At the appeals hearing, they read the stipulation saying I was previously found guilty of X and Y. Also, that I “waived my Due Process arguments” and that I “received all the Due Process that was due”. After which, opposing counsel read off new allegations that were never at the hearing. Specifically, that I attempted to mislead investigators about an agreement which only applied to a second court-martial. I had two separate agreements, but Keith did not listen and said it was a “bad-argument” telling me he doesn’t like how it was worded in another document. In other words, he let them say whatever they wanted and since he wasn’t letting me testify, they got away with it. Oh, remember those notes? Keith wrote a memo of law at the last minute which was rejected. He did not re-submit the notes as an exhibit. Nor did he ask the investigator about the inconsistencies of her report. For example, she wrote I lied about the office keys not working. Her notes actually said I “never had keys”. A bum off the street would have picked up on this. But this lawyer actually told me “I think she was confused”. SHE WAS LYING. He made really bad arguments, too many to go into detail. He didn’t even adequately defend me on the slam-dunk issues involving the so-called felony. There were Supreme Court decisions on this, which he agreed was the law, but did not bother submitting it at the Board. His “strategy” was to ask for backpay. Brilliant, I would have hired a bum to read off the questions I prepared if I knew he was going to do this. Afterward he told me “you knew you had it [the discharge]”. That’s not the point, I told them I did. “You thought you’d get away with it”. “To bad they found your [previous court filings]”. “I get it, you were swinging for the fences for backpay”. “I told you I’d take your money”. Three separate courts concluded he waived all my rights. I told him several times, once in email, to get a “bill of particulars” because I was afraid the other lawyer would make-up new statements and allegations. He blew me off and destroyed my case, essentially calling me a liar and agreeing with their side.

AN AMAZING LAWYER AND ADVISOR

Keith was an outstanding advisor and lawyer during a two and a half year ordeal that ultimately led to a Board of Inquiry. Throughout the whole entire process Keith provided me with amazing service and most importantly put my mind at ease. Once at the BOI, Keith provided an amazing defense and was ul...timately successful as I was retained in the Naval service. My only regret is not calling Keith sooner in the process. Thank you Keith for preserving my career and protecting what I have worked so very hard for. You have been a blessing to me and my family!!! Again my many thanks!!!

Grateful and so appreciated to have had these guys on my team.

Both Keith Scherer and Greg Gagne have changed my life completely. Long story short I was accused of some pretty horrible things from my previous marriage that followed me through my separation, deployment phase and divorce that stemmed from spousal support and deployment pay eventually putting me in... an extension passing my ETS date by one year. Pretty much Family Advocacy Program, XVIII Corps Inspector General, Criminal Investigative Detectives and my whole chain of command were involved not to mention a couple of officers from Fayetteville Police Department. Being that this was a SHARP/ SARC incident I felt as though I wouldn't stand a chance at proving my innocence. Here in Fort Bragg, each defendant is allowed 2 military lawyers from Trial Defense Services at no expense and being how these specific cases (Rape, assault, etc.) are sometimes biased, the needed effort to ensure my innocence could be proven needed to be doubled. My father had been researching a good lawyer who is oriented in Court Martial cases and had plenty of positive reviews from those who were once in my shoes. After 4 long days in the court room deciding my fate by a selected jury panel, I was acquitted on all charges and I'm now a free man who will be out processing soon with my hard earned benefits and DD-214 in hand. My current wife and I can continue to live our lives without the burden or stress of my ex wife and I will be able to sleep comfortably knowing that I won't be a registered sex offender or be thrown into Leavenworth. I would suggest hiring Keith Scherer and Greg Gagne for every reason known to man, most importantly for freedom in which we as military service members had served for.

Best lawyer in the world

Mr. Scherer is by far the best lawyer I could've asked for, I was facing charges for being awol, and was detained by the police after getting caught. He talked to the people back on base about me and got all the paper work done while I was in jail, so all I had to was sign a paper and be on my way.. ...His knowledge and professionalism really gave me a peace of mind and helped me not freak out.. I was out of the army after two days of going back on post. Definently recommend him for anyone whose having legal troubles while in the army

Absolutely the Best!!

Mr. Keith Scherer and Mr. Greg Gagne are two amazing Attorneys. When something unexpected happen that you have worked your whole life for and can could be taken away. You want the right people to get the best possible results for your situation. That is what I found in the Gagne, Scherer & Associate...s' Team.
