Exceptional Guidance Through a Complex Immigration Case

This review is long overdue, but I’m happy to finally write it now that my H-1B visa has been approved under a waiver. My case was far from straightforward—the U.S. consulate took an entire year to process my application, and my situation was made even more complicated by my ex-fiancé’s mishandled EB...-5 application. Nothing short of amazing!

Dyan Williams has been imperative in our I-130, I-485 and I-601 journey. I came to the USA in November 2019, and had sought out a B-2 Visa to do so. I needed the waiver of inadmissibility due to something from my past back in 2007. Upon entering the USA, I knew it would be a short 4-5 month stay wit...h friends before returning home to Australia, however, the pandemic happened and my flights were canceled. During the time I was here, I applied for an I-539N extension and was granted a stay until November 2020. During that time, I met my now husband, whom I had known online for many years prior to meeting him in person. After spending so many months together, and still not knowing when I would be able to return home to Australia due to pandemic restrictions, he and I decided that we wanted to share a life together and took the steps to make that happen. Part of that process was finding an immigration lawyer that had the right expertise in order to assist us during that journey. Neither my partner or I have ever attempted such a feat, and had no idea where to begin, how to submit any of the applications, nor what was required of us. Dyan was referred to us by a friend. Her expertise is second to none. She assisted us with all the applications, told us which documents would be required, and submitted everything for us. In May 2023 we did a joint filing for applications I-130 and the I-485. We received several RFE (request for evidence) notices from USCIS and Dyan assisted us with every one of them ensuring they were submitted for us by the USCIS due dates. Dyan made it easy to understand the process and coached us through every possible outcome. My I-765 (Employment authorization) was approved first in June 2024. My I-130 (Petition For Alien Relative) was approved in September 2024. I was then required to go to an interview for the I-485 in December 2024. Dyan suggested that we find local council to assist us during the interview as we are in Alabama and she is in Minnesota. She had successfully been assisting us remotely this entire time without issue. However, we were not able to find a lawyer experienced enough or available on that date to meet us at the interview. I personally also felt that Dyan knew our case the best as she had been with us since the beginning and it would be better to have Dyan on the phone at the interview (if she was willing), rather than someone new, or no lawyer at all. Due to being unable to find a suitable lawyer in our area, Dyan went above and beyond to guide us to a resolution for this problem. Dyan assisted by clearing her schedule in order to be there for when the USCIS officer would call. The USCIS officer was also kind enough to call Dyan for us while I had my interview. Dyan worked diligently to prepare our I-601 (Waiver of grounds of inadmissibility) application and submitted it prior to my interview to ensure that the USCIS office had all the information they needed about my case. I had a permanent bar to the U.S. under INA 212(a)(2)(A)(i)(I), and had previously gotten the 212(d)(3) waiver for the visitor visa. But to obtain the green card, I needed the I-601 waiver, which is harder to get. I had to convince USCIS that my indiscretions had occurred more than 15 years ago, I was fully rehabilitated, and I posed no risk of harm to the welfare of the United States OR my U.S. citizen spouse would face extreme hardship if I was not admitted to the United States. Dyan helped us prove that I qualified for the I-601 waiver not just on one of the eligibility grounds, but on BOTH of them. In February 2025, my I-485 and I-601 applications were both approved. We are exceptionally grateful to have had Dyan see us through this entire process. We would highly recommend her services should you need an immigration lawyer. We thank Dyan once again for all her help and support throughout this long and complicated process!

Lawyer to bet on for most complicated cases

I am an Indian and went for visa stamping at Mexico consulate for H1B where my stamping was denied with 212(a)(6)(c)(i) bar which is a lifetime ban to enter US. After the bar I consulted 2-3 attorneys but did not get any positive response. Most of the lawyers in US are not aware that a life time ba...r can be reversed with correct documentation if you know that you not misrepresented anything . My case was similar I was given 212(a)(6)(c)(i) due to some issue with my employer with whom I entered the country on H1 after that I did visa transfer to 2 more employers but still stamping was denied. After doing my research on the best lawyer in US to work on 212(a)(6)(c)(i) I took consultation from Dyan after moving back to India and explained all the details on all my visa and stay in US and she suggested that we can prepare the proper documentation to get the bar removed . She was hopeful about my case which gave me hopes. I hired Dyan to work on my case. Dyan primarily work on email communication only which initially I thought is not right but realized later that it was the proper way to do it . She will answer all your questions on email and will also give instructions and the timelines of progress which you can refer any time as its in email. She will ask you to prepare all the summary about your case regarding all visas and situation of denial. In my case she prepared legal memorandum along with affidavit and many more support letters to submit to US consulate during visa interview . Documentation was very detailed and to the point which will give your history in US from first day to last day. I took another visa appointment and went to consulate with the documentation to submit. Dyan gave details on how to answer the question and how to request to submit the documentation to visa counselor officer. I went for interview but to my disappointment the officer did not accepted any documentation and denied the visa again under 212(a)(6)(c)(i). Felt like months of effort is wasted but Dyan explained about the next step in which she asked me to save all the documentation in a google drive folder in proper format suggested by her. Dyan then submitted the documentation to direct contact email address of consulate ,but at this step also we did not get any favourable response from consulate instead they advise us to contact legalnet . Legalnet which is also called supervisory review was the last step left with us at this point I was not hopeful of any positive result but Dyan suggested to submit the request for supervisory review. So I went ahead for submitting the documentation for supervisory review, Dyan then drafted the email to be sent for supervisory review . I read that response from legalnet can take months and is mostly negative. After around 3 months Dyan received a response with message that case is resolved and to communicate with consulate for further steps. At this time I contacted the consulate and sent the passport for stamping with visa stamped . In short is Dyan is one of the best lawyer out there in US out of few who work on these complicated cases . She is very knowledgable and answer all your questions with available options . I can’t Thank enough to Dyan for the excellent handling of my case .
