Far too often, I get phone calls from family members of a recently deceased person (who did not work with my office), and they are ready to sue a sibling, step parent, or some other relative over who's in charge or who's getting what.
The relationships in these families, will be destroyed by feuding that can span generations. Imagine your grandchildren not knowing each other because their parents (your children) were not able to get along.
When minor children are involved, planning should be focused on how the children would be provided for and cared for in the event of your passing. When these issues are left unsettled, a judge who doesn't even know your family will have to decide who will raise your children, and who should be in charge of their inheritance. I help my clients with young children address these critical components of their planning among a number of other particularly relevant issues.
When children are already adults, the focus of planning should shift to planning for what happens in the event of your incapacity, setting up approved access to assets and eventually, easy asset transfers to the adult-children outside the walls of any court.
