I was charged with an OVI/refusal in June and this would serve as my 3rd offense total, 2nd in ten. I was pulled over and arrested in Hudson and had all court proceedings at Stow Municipal. The officer was high pressure and made me feel completely uncomfortable so I refused the field sobriety tests ...and breathalyzer which automatically makes someone look guilty of driving while under the influence. At the suppression hearing the prosecutor was offering reckless op, with the possibility of 20 days jail, classes, 2 year suspension for refusal etc. Jon went back and forth several times talking to myself and the prosecutor before he finally got the prosecution to agree to physical control (no points- as the reckless would have added 6 points to my record, suspending it), no jail time, no classes, no extended alcohol monitoring and an immediate reinstatement of my license with full privileges waiving the $475 reinstatement fee. It was the best possible outcome, given my priors, without wasting too much time and money in court taking it to trial. I appreciate Jon’s persistence, listening to me and what I wanted and not taking the first deal the prosecution made. I was charged with a DUI in an affluent suburb of Akron and reside 4 hours away. I travel for work routinely and was entertaining on the night in question. I didn't blow but did complete the field sobriety test. It was my second in 10 years and third overall. I could not afford a conviction.
