Very unhappy

I hired Judith Delus more than a year ago for a landlord-tenant matter. This was my first time ever hiring a lawyer. I should have known when she made me pay $150 just to tell her about my case that all she wanted was my money. During the year she had my case, I only spoke with her 4 times. From Dece...mber of 2016 until I terminated our contract in June of 2017, I did not speak to her at all. When I started to ask questions about how she was handling my case, my phone calls and emails were more often than not ignored. I also found out that her office was billing me for every single email I sent, and every email that was responded to by her paralegals, and was told that Judith had her paralegals responding to me in order to "save me money", so I cut way back on my communications with her office for fear of exhausting my retainer just trying to get in touch with someone. In February I received an invoice from her that did not show a $500 payment I had made, so I sent an email asking for a correction. I then received two emails and a phone call explaining the mistake, and later found out I had been billed for all of those emails. I did not think this was fair, so I called to ask that these charges be removed. I was told that Judith was the only person who could make billing decisions, and that she was "busy", and that I would also be charged for this phone call, and if I was able to speak with Judith about it. I told them I didn't care, and spent the next few months sending emails asking to talk to Judith, but was completely ignored. I finally gave up because they were still charging me for any emails I sent. I do have documentation of all of this. Her paralegals would also "gaslight" me. When they would actually respond to my emails, they would start them by saying "The Attorney has tried to contact you..." my heart would drop, and I would check my cell, home, and work phones, but no missed calls from the attorney. This happened multiple times. They lost some of my medical records (that I had to pay a fee to get from the hospital) at one point, and I had to send them all new copies. Finally, I received an email that there had been a settlement offer on my case. I asked again for a meeting with Judith to discuss my options and was denied. I received another email from a paralegal saying the Attorney had tried to contact me, (she hadn't) and that my only option was to accept the very low initial offer or file a lawsuit. At this time I no longer trusted Judith, so I consulted with another lawyer (who did not charge me for a consultation) and he agreed that Judith's tactics were strange, and seemed unethical. I decided that if my case were to go to court, I no longer trusted Judith to take care of things. I then attempted to set up a meeting with her, and 4 emails went ignored. I sent her two emails with a termination agreement and noted in the emails that I would be coming by her office the next day at a specific time to deliver the termination letter in person. When I showed up the next day she acted like she had no idea I was coming and was visibly angry when I asked her to sign a form saying she had received my termination agreement. At this time I had $1,000 in a trust account with her, and I asked for those funds to be returned to me since she would no longer be working on my case. She said she'd have them to me by the end of the week. That evening I received an email from one of her paralegals saying I was not entitled to the remaining funds, citing a paragraph in my engagement agreement that referenced the initial retainer I paid her being non-refundable. At this point, I had paid her more than $4,000, and the initial retainer had been exhausted. I am currently filing a complaint against her with the GA State Bar, and have consulted with an Ethics Attorney as well. I hope others who have had problems with her do the same so she can be held accountable for her actions.

This firm prides itself on providing legal representation with integrity. However, not everyone will leave satisfied. Ma'am we are sorry to hear you were not pleased with your representation but dishonest statements must be addressed. This firm does not handle personal injury cases. We handle landlord/tenant mold cases. Therefore, everyone who comes to this firm will pay a consultation fee of $150. This fee will be credited toward your retainer should you retain. This client signed a consult notice where these fees were explained. A consultation is an opportunity for an attorney to hear facts of the case and determine if there is a strategy to meet the clients goal. This client attended the consult and then retained this firm. She then signed an engagement letter that clearly states her fees are non-refundable and earned upon receipt of this firm working on her case. Should the client decide to terminate the firm which they are free to do. The client doesn't get any parts of their retainer back especially after the firm has worked over a year on their case and have obtained a 5 figure settlement offer from the insurance company. This client unfortunately felt she was entitled to more and I legally advised her on many occasions of her other legal options and next steps she could take. However, she didn't want to pay additional legal fees which is understandable as litigation is always costly. This client came to my office without an appointment although she's aware that the firm policy requires an appointment as outlined in the firms engagement letter. That was read and signed by the client. The client was then provided a copy of said engagement letter to refer to. When the client came in unannounced I offered to have a discussion with her to address her concerns or any issues she wanted me to address. However, she stated she did not wish to discuss anything while I was in the midst of training a new employee because I was short of staff. This client sent emails to my paralegal directly. However, this paralegal is currently on personal leave and never received any responses. However, the client had the firms general email and could have contacted the office directly if she did not receive a response by email in a timely matter as the firms policy is to respond to clients within 24-48 hours either by phone or email. Lastly, this client has requested a non-refundable retainer back which contractually she is not entitled to and I personally advised her to reach out to the Georgia Bar and to date her grievances has not been responded to and my firm has not been contacted regarding this matter. Unfortunately, this firm has been through this before when you've been practicing for several years these reviews will come although few and far between. Therefore, we welcome the opportunity to respond to the Georgia bar and provide all documentation needed for them to determine a final outcome on this clients grievance. Ma'am we wish you all the best with your case and find it unfortunate we had to part on these terms after all the work our firm has done. This firm is proud that we were able to get a settlement on your behalf and will continue to seek many more settlements for our future clients such as yours.
