I am a litigator and practice in two primary areas: severe personal injury and estate-related litigation.  On the personal injury side, I have helped hundreds of clients receive (in total) millions and millions of dollars.  On the estate litigation side, I have pursued and defended will caveats, trust disputes, life insurance beneficiary disputes, and all sorts of other matters related to inheritance issues.  I handle these claims on both an hourly basis and a contingency-fee basis, depending on the nature of the case and the client's preferences.  Again, I have successfully recovered many millions of dollars for my clients.

I grew up in Henderson, North Carolina.  I graduated from Northern Vance High School in 1995, and then went to Wake Forest University.  I graduated magna cum laude from Wake Forest in three-and-a-half years, and then enrolled in the UNC-Chapel Hill law school. I graduated law school in 2002 with honors, was invited to join the UNC Law Review, and was on the National Moot Court team.

In 2002, I began work for Troutman Sanders LLP - one of the oldest and largest firms in Atlanta, Georgia.  In 2007, I moved to Raleigh, North Carolina to be closer to family and friends, and began working at my current firm, Burns, Day & Presnell P.A..  I became a partner here in 2010.

I am married, have two kids, and enjoy playing golf and fishing.

A case of neglect and abuse to a non-verbal Autistic Individual
I put my 17 y.o. son in a group home thinking it would be in his best interest and it turned into a nightmare. He was seriously burned (1st, 2nd and in some areas possibly 3rd degree) over his shoulder and back, inches from his face. There was a thorough investigation, staff was arrested and charged, but no one confessed and my son couldn't tell me what happened or who did it. So, the group home took the stance that this incident did not happen on their watch at their group home. Despite some documented reports and other obvious information regarding this case, the owners and manager of this group home decided to flat out deny that they were responsible in any way for my son's injuries. Needless to say, this was a complicated case. I learned quickly that most attorneys prefer to avoid such cases, but Jay Mills was very willing to help and I will always be grateful. It was important to me that the owners and manager of this group home did not get to walk away from this incident without experiencing some repercussions for being the sort of people that would do this monstrous act and deny it. Jay Mills supported my need to advocate for my son and guided me through this very difficult ordeal including the legal process of a civil law suit. I highly recommend Jay.

Outstanding Representation

Jay Mills is a truly outstanding attorney and I couldn’t be more satisfied with his legal representation. My case was one of a kind. As complicated as it was having to deal with several different people and they all had an attorneys in four different states. Jay manages to see me thru it all as painful as it was we survived. Jay is a very talented attorney who knows his stuff and he does his research. Annuity Fraud
One of the dearest people I have met in life was a victim of annuity fraud by a family member - in a desperate attempt to help try to right this horrendous act - I found the phone number of James Mills. I gave the number to him, stating simply - "you will not know unless you reach out and talk to someone" - little did either of us realize how wonderful, caring, and spectacular the person on the other end of that phone call would be. Jay Mills was a gift - to a kid in a full tailspin - who desperately needed to hear all that Jay was saying. What had happened was unprecedented - but Jay ensured that for the first time in a very long time - someone was standing up for this kid - taking the fight on - and ensuring that what a mother and grandfather had meant for him would be recognized and following thru to see that yes, he had vindication. It is true that once the lawyers are brought in, you can never make it right, only better - but I can attest to this - Jay Mills was extraordinary and made it a life experience that can now be put behind this son - and he can move forward - thinking more of how he was loved and looked out for, rather than how he was screwed. It was Jay Mills, the voice on the other end of that phone that proved to be a life changing person. I hope that he remembers, that while doing your job - you helped ensure the future of this son was not spent looking back but looking forward. James J Mills is a good person in a not so good world fighting for what is right.

Thank God for James Mills!
Our family has just been through a three year ordeal when a caveat was placed on my sister's will. James Mills was the reason we made it through. He is personable, kind, compassionent, and most important,the best friend you will ever need in this kind of litigation. His sense of humor keeps you on track when you are so confused and thinking,"How did this happen?" When your character is being questioned and you are told you can not be trusted, he constantly reminds you this is only the opinion of one person. He restores your faith in your own self worth. My family adores Jay Mills! He will stick with you to the end, always trying to comprehend what is in the best interest of his client. He knows how to pick a jury and he interacts with them well during the trial. He is conscious of the time the jury gives to your case and does not repeat things over and over that they have already heard. Best out there, Very Personable, & Considerate
My mother was in an odd accident in a major box store that did not want to take any responsibility for their actions. Jay took the time to listen to my Mother and hear all about her and her case. He guided her along the way without ever making her feel that she had to make any choice that she was not comfortable with. Jay was the only one that could talk with my mother and give her a sense of calm. He was always willing to communicate with me or my mother at any time. It also showed during many times during the case that Jay is very knowledgeable and very good at what he does. He was always up front and honest and at the end of the day helped my mother reach a conclusion to her case that she was happy and at peace with. I will always recommend Jay to any and everyone. Jay will be the first that my family will ever contact if it is ever needed. P.S. I want to address the person that gave Jay the one star review. Slip And Fall -Out of State Resident
I'm from out of state and needed a lawyer for a slip and fall when vacationing in NC. I was turned down by 5 other lawyers from the state but was lucky when Jay took on my case. He was very honest, and explained that slip and fall cases in NC were not easy cases to win. His persistence and knowledge paid off and he managed to get me an outstanding settlement. I can't say enough about Jay and his firm. They were wonderful to work with and always kept me informed.

Good luck getting a response...
I was interested in consulting with this individual and left him a message on his direct phone. Over a week passed with no response. I gave him the benefit of a doubt and visited his website, found his name among several and submitted a synopsis of my case with the hope of piquing his interest. Again, no response. I understand that attorneys have clients, deadlines, court appearances and such, but to completely blow me off is unacceptable and highly indicative of the probable future treatment I would have received had he been hired. If he wasn't interested in my case or had too large of a case load, it would have taken him five minutes or less to return my call (or to email), to say as much and to possibly refer me to someone else. I had taken the time to research Jenkins, to make a call and to write a synopsis. I would think he could have respected that and shown me the courtesy of investing five minutes on my behalf. There is a thing called the "Statute of Limitations," and wasting my time while I waited...and waited...could very well have caused harm to my case. It's a good thing that waiting didn't do significant damage.

Disrespectful,Lack of communication and not worth it.
I hired this attorney for a caretaker that abused my parents estate,and committed fraud.At first he seemed concerned but as the case lingered on,communication was terrible and he became disrespectful to me.Jay and his firm lost interest in the case and convinced me to settle because they were only interested in the money and not justice that this person deserved.I would not recommend him or his firm.

I have been practicing law for more than ten years. I can unequivocally say that "David", who left this review, is the most difficult and least grateful client I have had during those ten years. When he and his wife first contacted me, we learned that he was set to inherit nothing more than 1/3 of his parent's house. He hired me to try to recover some of his inheritance, as he had been left with virtually nothing by his mother and father. After a year of litigating his case, we recovered hundreds of thousands of dollars for both "David" and his sister. All told, they recovered in excess of $700,000. Unfortunately, that was not enough for "David." He wanted to have the defendant arrested and thrown in jail, or ruined publicly and financially, or who knows what. "David" simply could not, or refused, to understand that those were not appropriate remedies given the facts of his case. In addition, after recovering his settlement, "David" refused to pay our firm's attorneys' fees per the contract he had entered into at the beginning of the representation, which forced our firm to have no choice but to sue him for thousands of dollars. He eventually paid our fees out of the hundreds of thousands we had recovered on his behalf, but even then he did not pay the full amount owed - we simply tried to let it go. At the end of the day, litigation is an emotional process. This is particularly true when dealing with estate and family matters. I believe that an attorney's job is to take as much of the emotion out of the discussion as much as possible, and to focus on getting the best result possible for the client. David hired me to recover as much money as possible from his parent's estates. That is exactly what we did, and we did so with excellent results. Ultimately, "David" was given the option of signing a settlement agreement. He did so, and he did so willingly, and with full understanding of what he was doing, and with his wife notarizing his signature. He did so after several hours of discussions with his attorneys, and after days of consideration. Apparently, once he received his settlement, he decided it was not enough, and he has been unable to let the emotional issues surrounding this litigation go. That is disappointing. It is also disappointing that he has chosen to now leave me such a negative review, approximately a year after he received all of that money that we fought to get him. I stand 100% behind the legal services I offered "David", and regret that he remains dissatisfied.
