Wrongful Foreclosure

I give Brian three stars for taking my call and providing his legal advice. Free consultation is nice to have. :) However, I felt very unhappy at the end of the call. Our house was wrongfully foreclosed upon and the bank had admitted wrongdoing in a letter they sent along with a few hundreds of c...heck. I talked to Brian about exploring my legal options and he was very dismissive. Unlike other attorneys I subsequently called, he wouldn’t even take a look at the letter I had received along with the check. He said something along the lines of: “ This is probably a class-action suit or a settlement with the Attorney General. The $$ is all you get.” It wasn’t a class-action and wasn’t a settlement with the AG either. He wasn’t willing to look into it further. His tone was a gut-punch. He said the statute of limitation was five years and I later found out it depends on the state. After speaking with others attorneys, I called him again to express how I felt during the call, but he didn’t seem to notice anything was wrong. He was just completely silent. I was referred to him by another attorney and upon reading his reviews, decided to contact. I’m a proud immigrant and perhaps my accent was a deal-breaker for him. My bottom-line: Will not contact him again in the future.

Thanks for calling my office twice yesterday and for discussing your case with me. As I told you, your case is outside my practice area -- we only help clients who are facing foreclosure -- but I am glad I was able to give you some helpful information. We remember our conversations a bit differently. I hate giving bad news to good people, and my analysis obviously was not what you wanted to hear. While I try to be as candid as possible, however, I am never dismissive because the folks who call my office need support, not criticism. Nonetheless, I'm still sorry for the way our talk made you feel. I wish you nothing but the best of luck!
