Extremely ineffective in evidence review and representation

I had brealin assigned as a defense on a burglary 3/ grand larceny 4 case. The case was handled as follows : Breslin did not properly review the evidence. He stated i was "caught red handed" and said in court "there is video of my client committing this crime". Breslin merely took the camera footage... for my guilt rather than review it for flaws, as an attorney is supposed to do. On the grand larceny 4 count in the indictment, I attempted to tell breslin several times I was overcharged and requested he file a motion to reduce my grand larceny charge, as current market value of property at time of the crime was well below the charged amount of 1,381$ and much well below 1,000$ threshold to establish grand larceny. Breslin filed no motions and waived all my motions despite my request to file for reduction. He stipulated with the district attorney for a suppression of a police interview which did not hold any weight compared to the additional evidence. It appears this was done solely to avoid an ineffective counsel claim and to appear as though he put effort into my case. Breslin continued to pressure me into a plea deal for state prison which I repeatedly denied. The judge was against me at first and it did not look good for me. After firing breslin, a second attorney, Trevor Hannigan, reviewed the footage and discovered I was charged in a duplicity manner on the burglary 3 count, meaning the number of times I entered and exited said property was all compounded under one charge, which is illegal under ny cpl 200.80, duplicitous counts prohibited. Had breslin properly reviewed all the evidence for flaws in how I was charged by the grand jury in the indictment, perhaps he would have noticed this. Mr hannigan noticing this flaw ultimately set up grounds for a 30.30 speedy trial dismissal motion, which would have been granted had I not agreed to a misdemeanor plea for sake of saving myself 3-6 more months in jail waiting for a ruling which would have been in my favor. The court acknowledged the defective indictment and likely was a driving force, along with Mr hannigan, in securing my release and misdemeanor plea to criminal trespass 2nd degree, a class a misdemeanor. Had I kept breslin as counsel, I was practically guaranteed state prison time which another attorney had to save me from. Mr. Hannigan additionally challenged the grand larceny charge, which his motion was granted and the grand larceny was reduced to petit larceny prior to a motion to dismiss under 200.80 for the burglary count, which was rebutted by the district attorney by filing a superseding indictment, only to be challenged again my Mr. Hannigan's 30.30 motion which ultimately prevailed. Breslin did not review nor even consider any potential flaws, of which Mr. Hannigan's representation proved there were several. The only help breslin gave me was his ineffective counsel, essentially setting the stage for a speedy trial dismissal motion, due to the amount of time breslin had my case. Breslin was highly ineffective, did not send me copies of all evidence despite requests via voicemail until after I requested it directly in court and stated I would not plead without reviewing all evidence against me. Breslin appeared frustrated at my calls to his cell phone, listed on his business card, which occurred after numerous jail calls to his office went unreturned and unanswered. Breslin claimed he consulted with me at albany county jail in court; however jail visit logs show this is false. A complaint against him has been lodged with the attorney grievance committee. I would NOT recommend this attorney, at least not from my experience.

He lies! That was the deal breaker for me also he will not answer your questions properly and he will avoid you like the plague

I would avoid hiring Mr Breslin and his firm at all costs. He flat out lied to me and never answered my calls or answered my important questions. Always got some weak answer weeks after I asked him and was never a direct answer to my important questions. I believe Mr Breslin works in the district att...orney and the Court's favor against you if he is hired as a public defender which in my case he was. Told him many times if he didn't do his job and if he didn't start answering my questions and treating me like a client that I was going to leave him a bad review. When told that he threatened to sue me. Well good luck this is called freedom of speech buddy

Excellent representation, best outcome, and all-around great person

I hired Mr. Breslin to represent me in a relatively straightforward misdemeanor larceny case and could not have been happier with the representation he provided as well as the outcome he procured for me. From the very beginning, he was reliable and quick in responding to my inquiries, and took the ti...me to answer all of my questions in a thorough, kind, and professional way. My case was relatively minor, but I never felt that this affected his level of attention or commitment to my case. His fee structure was transparent and fair (he charges a flat fee for petit larceny cases), and payment was easy through an online system. Pandemic-related restrictions resulted in multiple delays with the courts (outside of anyone's control), but Mr. Breslin kept me informed and helped me navigate the changes in procedure; I always felt that I could count on him to provide the knowledge and support necessary to help me through the process. Additionally, Mr. Breslin demonstrated familiarity and experience with the local court, law enforcement, and prosecutorial professionals, and I gathered that his reputation within the local justice community was of great benefit to my case. Mr. Breslin was ultimately able to secure the best possible outcome for me, and I could not be happier with the way that he handled my case and treated me as a person—always with professionalism and respect. I could not recommend him highly enough and if I were ever in need of future legal representation he would be my first call.

Knowledgeable and Assuring
