OUTCOME: Federal Indictment Dismissed

After indicting my client, the government failed to arrest him, or take meaningful steps to even try to arrest him, for about 28 months. At that time, my client was coincidentally arrested after a stat ... e traffic stop. I moved for dismissal of the indictment pursuant to the government's violation of my client's Sixth Amendment right to a speedy trial and the federal judge agreed, and dismissed the entire indictment. My client was released from jail later the same day after several months of pre-trial incarceration. The government has appealed the case.

OUTCOME: Settled

My client claimed to have earned a significant real estate commission, but was frozen out of the final deal, forcing him to sue. The case survived summary judgment, and the defendants appealed. The App ... ellate Division, Third Department agreed with me, and held that an arbitration clause that the defendants were trying to enforce did not apply, allowing the case to continue.
