Severance Pay Out - Need advice on legal terms for severance pay out. Are you requried to fullfill 90 day notice if offered?

I am sorry to hear of your circumstances. The language in the severance agreement will dictate whether or not you can leave before the 90 day period.

At a minimum, you may need insurance to protect you from a lawsuit. You may also consider incorporating in order to protect you.
