Replied last November 26, 2024Thank you for sharing your thoughts and for acknowledging my knowledge and approachability as an attorney. I truly regret to hear that your experience has not met your expectations, and I take your concerns very seriously. As you know, your divorce was finalized and the retainer clearly states that post judgment QDRO drafting is not handled by my office, but by outside actuaries. Given the contentious litigation between the parties, the revolving door of attorneys on the other side, and the complexity of the offsets and distribution, I remained committed to help see it completed. As you have been made aware, the responsibility for filing and executing a QDRO is a shared endeavor that requires coordination and cooperation among the member, alternate payee, legal professionals, plan administrators, and the judiciary. I am but one of those handling the post judgment distribution. I have no control of the timing of the production of account statements from opposing parties, the drafting of the QDRO(s), or the actual distribution once it is finally submitted to the plan administrators. Any follow up after such submission is between the alternate payee and the plan administrator, and maybe that was not made clear enough. I appreciate your patience with my medical issues, treatments and surgery this past year but you are aware that is no longer an issue. Typical QDRO execution takes many months to years, your case not being the exception. I understand your frustration with the delays and communication issues you've encountered. While it's true that I am a solo practitioner, I recognize the importance of maintaining clear communication and fulfilling commitments to the best of my ability. It is a balance in the frequency of communication, the lack of anything to report, and the resulting increased billing due for such time expended. Your feedback is a valuable reminder of how critical the final stages of any case are, and I sincerely apologize if you believe I have fallen short in this regard.
