James A. Abate is a partner with Aiello Harris Abate Law Group. Mr. Abate practice is focused in Criminal Law, DWI Defense, Domestic Violence and Appelate practice. Mr. Abate is certified as an instructor in the adminstration of Standardized Field Sobrierty Testing (SFST) and Drug Recognition Evaluator (DRE) tests. Mr. Abate recently moderated the symposium "Emerging From The Pandemic" which featured a whos who of Judges, Prosecutors and Defense Counsel. Mr. Abate is a member of the Association of Criminal Defense Lawyers of New Jersey (ACDLNJ), National College for DWI Defense and Mr. Abate is the Legislative Chair for the New Jersey Bar Association Municipal Court Practice Section.

Replied last April 27, 2021I appreciate the feed back. However, this was a second offense DWI in which you received no loss of license. Quite frankly, any attorney would be pleased with that result. We would have loved to get you a shorter interlock period, but the prosecutor and judge were unwilling to go there without an expert report. I offered to keep fighting and obtain an expert report. Unfortunately, you declined to do so as there was no guarantee of success. You emailed me 29 times and each time I personally responded. You were in touch with other members of my staff as well by email and phone. I feel we were very prompt in responding to to you. But we are always trying to improve. My associate John appeared with you at the first court date via video and I am not aware of any issues. The second court date I had a power outage and with the session being via video the status conference had to be rescheduled. We were very apologetic about a situation that could be not be helped. I hope that you never have to go through anything like this again and we all wish you well.
