No movement on case

The lawyer given to me was Effie and was distant from the beginning. She simply wanted billable hours for a case that was not difficult and I was charged over $10,000 in one month. We made no progress on getting joint physical custody. They charge credit cards. They had difficulty using Dropbox and w...anted me to send all files by email, which I refused. I do not recommend this large firm.

Hi Josh, I’m sorry to learn of your experience and I’m happy to discuss it with you. You have my email and phone number, so please reach out when convenient if you’d like. I'm also sending this to you by email proactively in case you don't receive the notification of my response. We certainly don’t want you to be dissatisfied with the representation. I’ve personally found Effie to be a highly capable and compassionate advocate, and she feels you had a good working relationship so it would be helpful to gain a better understanding of your impression of the relationship. One challenge with litigating in the probate and family court is that things do not tend to progress very quickly. The legal fees are charged hourly here, as is the case with nearly all family law attorneys, and that can admittedly lead to a significant expense in a single month when there’s substantial activity, such as drafting and exchange discovery and representing a client in a court hearing. Attorney representation in a family law case is generally an expensive investment. If we’re stuck in court waiting for several hours to be called, for instance, we’ll use that time as best we can to make progress and resolve things, but we’re unfortunately still stuck there until our case is called and you’re paying for that time on an hourly basis. We do offer options to help clients control costs, including offering limited assistance representation which clients may use to handle aspects of their cases themselves and may also terminate the representation at any point stopping the billing without a need for us to formally withdraw. When we are engaged to handle significant issues and court activity in a short period of time, the cost will be substantial. We collect smaller retainers that most family law firms and we provide weekly statements of activity so our clients can more closely monitor the expense. Lastly, we have a fee dispute process that I’d be happy to discuss with you. It’s a two-tiered system set forth in detail in your retainer agreement. The first step is for you to review your bill and email me your concerns with any particular billing entries along with your concern. You’re required to do that within 14 days of receiving the statement per the retainer agreement, but I’m happy to make an exception to better understand the concern. I engaged this law firm for my divorce after Damian Turco assured me that he had and his firm had many lawyers with forensic financial accounting expertise. This turned out to be disingenuous. Damian passed the case to an associate, Amanda Gnau who was very inattentive to my case and failed to commun...icate with me as to updates on my case as she always had some excuse why it typically took her 2 or more weeks to call me back. The one time we were heard in court after a year of representation, Amanda misrepresented facts to the court and when I confronted her about it she stated” it won’t be an issue, she got so flustered by my husbands attorney that she misspoke”. Well it was an issue since my husband threatened to have me charged with perjury. I contacted Amanda to correct the record with the court and her response was that we had a breakdown in communication and she was going to withdraw from the case. I contacted Damien to take over the case or provide another attorney to which he replied that now that he is president of the MA Bar Assoc. he does not take cases and he wouldn’t provide another attorney out of 12 in his firm to take over the case. I have paid his firm $45,000 for them to withdraw 1 court day before my pre-trial conference. I have been abandoned , betrayed, and taken advantage of by this firm during a difficult time of going through a divorce after 30 years of marriage.

I'm sorry for your experience. Amanda is an outstanding attorney, and I routinely receive positive feedback from her clients. I've seen her produce exemplary work product, but it may not have been the right match. I also apologize that it appears we did not effectively communicate our experience with complex financial matters. We manage financially complex legal issues very day, including the need to identify transactions that may have occurred with the intent to hide assets in anticipation of a divorce. Several of our team members have achieved Certified Financial Litigator status from the AACFL, but that does not qualify us to do forensic accounting. When there are allegations of fraudulent transfers of wealth, an assessment is conducted by the attorney as to whether a forensic accountant or other financial expert should be engaged to further investigate the allegations. There are sometimes cases in which a fraudulent transfer is a single transaction. In other cases, there may be allegations of an ongoing pattern of deception. While an expert may not be necessary to investigate a single transfer, it may be necessary to establish a pattern. The decision to engage an expert in such an instance involves a cost/benefit analysis and is the client's decision to be made with the help of our insights. We try to be clear about when we might need to engage a financial expert, in the retainer agreement and also in discussions regarding allegations involving financial complexity throughout the representation, but it does not appear as though we were successful in this instance. I hired Turco Legal and it was a waste of 1 year of legal fees. I fired them and hired another attorney that was better. I would not recommend them they are just trying to get billable hours.

Would not recommend this firm for divorce

Case was transferred to associates. They did a very poor job, wasting my time and money. Received regular invoices for production, meetings, and essentially little movement. For 1 year of legal fees and not much to show for it, I was invoiced more by Turco Legal than I was over the course of over 3 y...ears by my subsequent divorce attorney that was attentive, efficient, and had a fantastic outcome.
