Ok, so you have a great idea for a company to either: (a) manufacture a product; (b) import a foreign made product into the USA; or (c) sell either of (a) or (b). Can you simply go full steam ahead and just worry about sales? NO!! Like the Boy Scout motto says "Be Prepared".

You don’t need to register to sue somebody for using your mark. However, it’s a good idea to file an application with the U.S. Patent and Trademark Office to register your mark.
