Description: Defendant was convicted by jury in the Superior Court, of second degree burglary. Defendant appealed. I drafted the appellate brief on behalf of the State as a Rule 9 intern under the supervision of Kathleen Proctor. Defendant argued that a garage, without a door, is not a building. There was no case law directly on point as to what was a building and what was not. Sucessfully argued that a garage without a door is in fact a building. Division II affirmed the conviction and published the case.
