I recently needed an attorney to represent me in a Domestic Violence case. I had narrowed my search to Mr. Bennett and one other attorney after researching them extensively. The first attorney I met with left me with a feeling of uncertainty. After meeting with Mr. Bennett, there was no doubt that he was the one I wanted representing me. He has extensive knowledge of the laws and took the time to answer any questions that I had concerning them. He always kept me informed, and explained what was next in the process. We always communicated before each court date, and before court started on the scheduled dates. He even answered some questions I had that were not related to this case. Everyone I met in his office was professional and helpful.
Through Mr. Bennett, I was able to reach an agreement with the court that did not involve a trial.
I met a woman the last time we were in court who said that she had a family member that was accused of a similar offense, and was there to find out how the process worked and watch how different attorneys conducted themselves. She noticed how Mr. Bennett conducted himself, and asked me in the hall what my opinion of him was. I explained to her how Mr. Bennett had helped me, and I had no reservations in recommending him.

Mark is one of the few attorneys here in Houston that you absolutely have to consider for your representation. Mark doesn't guarantee that he will obtain the favorable outcome that you want to obtain when you've been accused of a crime, but I WILL guarantee you that you can rest easy once you have him on your team. He knows how to work the system and he will do the work you expect him to. That says a lot nowadays when attorneys are out to maximize there hourly rates by disposing of your case as quickly as possible. Mark does not have a huge volume of clients and therefore you are assured to have him work on your case as much as is needed to help you obtain a favorable decision on your case('s). Before I hired Mark, I witnessed first hand what other attorney's will do when they don't really care about whether or not you have your freedom. I had originally interviewed Mark after I was charged with one misdemeanor family assault and one felony evading in Harris County, but I felt he was too expensive and I thought I could get by with a cheaper defense. I screwed up an hired a guy off the Internet that advertised himself as the best affordable attorney in Houston. What a load of crap....that guy was horrible. Within two weeks I found my misdemeanor case being enhanced to a felony. Anyway, he seriously screwed me but I'll explain that on his review. Needless to say, I fired the guy and went back to Mark to please help me on my cases. I was very surprised he even wanted to touch them because of the wreckage the other attorney had caused but he accepted and didn't charge me anymore than what he originally quoted me. I felt a sense of ease after hiring Mark, after 3 weeks of going thru hell with that other bird brain as my counsel. I knew I was in much better hands with Mark. The other attorney had tried to get me to accept a plea on my charges that included a lot of jail time and 3 years of un-adjudicated probation following. All for two things I didn't do. Mark said no absolutely not, I'm going to try to get these no-billed by a grand jury and at worst we go to trial on both of them. That's another great thing about hiring Mark...his flat fee that you pay up front means you have already paid for your trial should it come to that. It really helps to put your mind at rest because you know that you have a darn fine lawyer that's in it with you for the long haul. It means a lot when your are facing serious penitentiary time, as I was facing 2-10yrs on both counts. So, long story shortened a little...5 weeks and 2 court dates and a grand jury presentation by the state and re-butted by Mark, and I find out last Monday that my cases had been "NO-BILLED" by the Grand Jury! Both of them. I don't know what Mark did in the room that day, but I will be forever indebted to him for providing me with my freedom.
In closing, Mark is not only at the top of his craft, but he cares about your freedom. He absolutely believes it is his duty to keep you from spending your life in a cage like a zoo pet. If you are facing serious charges that could ruin your life and everything you have achieved, Mark needs to be the person you call.

I needed a criminal defense attorney and Mark came recommended by close, personal friends within the legal industry. Whether you are experiencing the consequences of a momentary lack in judgement, a victim of circumstance or have a troubled past, when your life is on the line this is the guy to call. He personally answered his phone on a holiday weekend, my first appointment was on the actual holiday itself and he worked diligently throughout the course of the proceedings. He does not take every case, he can't...he is too hands on for that type of legal representation. I appreciated his vast and intricate knowledge of his craft. You will not get a guarantee of a result because there are no guarantees in life, Virginia. But you will get what you pay for and what you are paying for is top notch legal representation. He is worth every penny, plus some. I value my life and my freedom. There is no price I could put on that.
Not only would I recommend Mark but when I had a good friend (a grown man, Texan, professional engineer with a great job and amazing family) get into stupid, nonsensical, high stakes trouble in Georgia, I called Mark to refer a top professional in that state, with expertise in that county to replace the underperforming attorney he retained under the duress of the circumstance. This is long overdue (I thought I had posted this when it had occurred , but clearly did not). Mark helped our son get out of a couple of scrapes involving his vehicle. One incident involved a high profile attorney's daughter where we live. Even though we lived outside the Houston area, Mark was able to help us get to a good place with these events. No charges were filed on either side and a resolution was reached. I would reccomend Mark to anyone who needed a lawyer's help.

I was fortunate to find Mark Bennett. I felt like crap after receiving an arrest warrant for a collision I wasn't even involved in. No matter how innocent I was, 'probable cause' means the county thinks I am guilty and up to 6 months in jail is possible. Even if jail time is unlikely, who wants to gamble with it? A more likely outcome would be a plea bargain for probation. How could I agree to that when I did nothing wrong? I would rather risk a conviction and even jail time than plead guilty or no contest. I believe some lawyers prefer plea bargain because it is quick and easy and limits damage. But in my case it means accepting punishment for a crime I did not commit. Fortunately Mark saw it my way. Mark listened carefully to my story and asked many questions to ensure he understood the sequence of events I described. The part I like best about Mark's way of handling the case is that he accepted it for a fixed fee (flat rate). To me, the importance of flat rate is that presumably the prosecution knows that not only do I have the means to finance a jury trial defense, but I have already paid for one.
Be sure to read every word of Mark Bennett's web site, along with his blog. You will find many answers as well as useful advice. I am convinced Mark puts his beliefs about criminal justice way above personal gain (read his blog to see why). Mark really is a low volume lawyer. I dealt directly with him. He did not make any mistakes, and he was polite when I made mistakes. Though I did a huge amount of work to gather evidence of my innocence, Mark obtained two key items that were not possible for a private citizen to obtain. With any lawyer, I would suggest doing as much leg work and ordinary investigation for your case as possibly. No lawyer is magic. Provide material and let the lawyer decide what to use. I was prepared to give Mark a good review even if the outcome was less than perfect. Even if you are completely guilty, you need the best lawyer possible. I watched people get 6 months jail time for personal use of marijuana, something completely legal in other parts of the country. Oh, and the outcome for my case? DISMISSED! Thank you Mark.

When I first learned that I was in a lot of trouble and needing a lawyer, I searched for top defense attorneys in Houston. As soon as I found Mr.Bennett I knew he was the one for me. I called him the second I got out of court and was able to speak to him directly right away. From the very first time I sat down in his office I knew I had made the right choice hiring him. He took very good care of me and my case from start to finish. He listened to everything I had to say and kept in touch with me constantly. He was so aggressive with the prosecution that after we decided to go to trial, they dismissed my case simply because they knew they couldn't beat us. Mark was able to have the case no billed and had the TSA fine greatly reduced. He assisted in reducing bail bond restrictions with his own bonding company. Finally, he greatly reduced my anxiety and concerns in handling the case.

New Years Eve I was arrested for unlawful restraint it's a misdemeanor. I didn't think much about it. I hired and attorney Cheryl Brown ex assistaint DA. I went to court with her five times on this charge. The fifth time she said take the $200 fine and be done with it today. I tolde her she was fired, that was on a Friday. Monday I hired Mark Bennett. We went to court two weeks later and it was dismissed. If it had not been for Mark I would of lost my job and my career would have been over.

I was being charged with a Misdemeanor class B for possession of Marijuana. I am an illegal immigrant and I had a really high chance of being deported no matter what the outcome of the case would be. Before hiring Mark Bennett, another lawyer worked in my case but did not really provide me with any help and I wasn’t comfortable with this situation. After doing a lot of research, I determined that hiring Mark Bennett would be a good decision and in fact it turned out to be the smartest decision I have made in my life. Mark was able to get my case dismissed and I am now in the process of getting my record expunged. I would recommend him to anyone! He has a great character and is a very professional person that will be honest with you about anything that can happen with the case, but most importantly he is a lawyer that cares about his clients. Facing a charge would would likely harm my career, I searched high and low for an advocate. I called and interviewed several attorneys, but only Mark shot me straight. After talking with him further and reading his blog, I decided that I would hire him. I was not disappointed to say the least. Our family has counted our blessings for Mark Bennett many times. We asked that he be our son’s attorney during a time and crisis when we did not know what to do. Our son was falsely accused of a crime while on active military duty in Texas. We (his parents) are from Indiana. We are just a “regular†mid-west family comprised of teachers, social workers and college students. We had no idea where to turn or what to do. I prayed that we would find someone who could be there for our son and guide us through all of that horror. It was very difficult, as we were half way across the country when our son was going through the most difficult time of his life. Mark was the answer to that prayer. We called him; HE answered the phone. I worked as a legal assistant for five years prior to teaching; attorneys do not normally answer the phone. In fact, most often they do not even return their own phone calls. I knew early-on that Mark was a good person and that he would do whatever he could to help us. He took care of our son in a way that no other attorney could have. He treated him with dignity and respect through the entire process of completely clearing him from the entire legal mess. Our son went through hell during that period of time; Mr. Bennett made things bearable. Our son was able to continue his service to his country during this difficult time, serving two tours of duty – one in Iraq and one in Afghanistan – during both of which he saved many lives. I accidently took a handgun to the airport and was charged with a felony. I have never been in trouble before and a felony would be a disaster for my career. It was really important to me to find the best possible attorney with very little time. A friend and high level attorney recommened 3 choices with Mark being his choice if he had any trouble. I met Mark in short order and he was very helpful in explaning the process and reducing my stress. The case was no billed and he is filing for an expunction to clear the arrest from the record and negotiate with the TSA on the fine. I would recommend him without hesitation.

I was in a bit of a situation where I hired Mr. Bennett as my lawyer without ever having met him. A dear friend of mine who also practices law had highly recommended him, and when I spoke with him over the phone, he instilled some hope in me where there was none.
Having not yet formerly met him, I was sure to observe his interactions in the courtroom. I was impressed not only by the respect his peers gave him, but by his respect for them and the judge. This stood out immediately to me because in no way did he seem pretentious or pompous, and he wasn’t.
When we finally met, in no way did I feel judged or made to feel like a “jobâ€. He was very kind and took the time to make sure I understood everything. I feel that at this point I should say that my case was a bit tricky and the “outlook did not look good.†I could have potentially been left with a tarnished record that would have left me with an amazingly difficult future. Mark Bennett defended me when I was charged with a deadly conduct felony. The consequences of a conviction in my case were very serious, because I am not a US citizen and a conviction would have resulted not only in jail time or probation, but in deportation and permanent inability to return to the US. The incident involved firing a gun under very complex emotional conditions in a state of severe depression and acute suicidal tendencies. There was never any intent on my part to hurt anyone, and material damage was promptly compensated by me, but I did confess to the police at the time of my arrest. With my confession on tape, it seemed my chances were slim.
Mark immediately recognized a potential strategy for a defense, largely based on the way the charges were worded. He initially tried to get a pretrial diversion, but when that didn't work we focused on the weaknesses in the state's case and prepared for trial. At the pretrial hearing, the day before the case would have gone to court, Mark got the prosecutor to dismiss the case.
I have never before been in need of a criminal defense lawyer and I hope I will never need one again. So my frame of reference in making a recommendation is limited. But I can make a recommendation based not just on the successful outcome in my case. Throughout my long career, I have worked with all sorts of professionals in many disciplines. There is no doubt in my mind that Mark is very, very good in what he does. Moreover, he does so in a very personal way. He referred me to an exceptional therapist who has me firmly on a way to regain control of my life. Shortly before my trial date he organized a psychodrama session as part of my preparation as a witness. This was a life-changing experience and went way beyond just witness preparation. It was intensely personal and would not only have been a great help if my case had gone to trial, but will be something I will benefit from for the rest of my life.
We picked the Bennets as our lawyers based on their website - a risky thing to do when your whole life is at stake. After my arrest we got all sorts of aggressive letters from trial lawyers in the mail that were for the most part in truly bad taste. Mark's website is in good taste, as was his office. Nothing extravagant, but good taste, common sense and professionalism in evidence throughout.
So I hope that my posting of this reference on his site will help future clients to make up their minds. Not so much for the benefit of the Bennets, they seem busy enough, but more for the benefit of prospective clients who desperately need help. Since there is no rewind button in life, if you have done something really tragic or stupid, or are accused of something you are actually innocent of and need help in a legal defense, you owe it to yourself to talk to Mark.

I reviewed Avvo and interviewed several lawyers before deciding to hire Mark to represent me on a felony charge. Never had a violation, conviction or any other issues in my past, but cops & prosecutor wanted to pin felony charge on me. Mark kept my wife and I informed and we worked through the system -- he and I kept pushing the prosecutor to show us the photos taken on the day of the arrest and the cops kept postponing delivering this evidence. Mark finally got them to present the evidence and sure enough they had no case. So, Mark asked me if we should take prosecutors offer and I declined because I knew with Mark's experience they had no case, and we would win. The prosecutor dropped all charges and the case was dismissed. We need to reform this so called Justice Systems. In general, I highly recommend Mark Bennett, he is worth every penny. By the way, many lawyers tried to sell me their services as fear sales or other techniques --- don't go with them....call and meet with Mark Bennett.

After being accused of "verbal harassment," I spoke with Mark. From the outset I felt he would truly fight for my rights rather than push the case quickly through the legal system. He displayed an incredible amount of knowledge, intelligence, and empathy. These characteristics put me at ease and instilled a solid sense of trust. I was visiting the state of Houston for a family members wedding & unfortunately got myself into a bit of trouble... was accused of passing bad money & charged with a felony. Being that I'm from out of town and had no Idea where or who to turn to, a friend of the family recommended Mark & after meeting with him I had no doubt in my mind that he was the guy for the job. Trusting your future, life and career into someone’s hands is very nerve wrecking; however, it was not long after I dealt with Mark that those fears dissipated and I realized that I couldn’t have made a better choice. Mark is simply the best ethical attorney money could ever hire. He is sincere and honest, he will fight for you, but more importantly, Mark will motivate you to fight for yourself. One of Mark’s greatest attributes that I learned is how to become a realist and how to focus on facts that dismissed my cases. "People helping people." This is the motto of DWI defense attorney Mark Bennett, and I can tell you from my experience he is true to his word. When I began my search for an attorney, I didn't even know where to begin. I stumbled across Mark's website, and after a few meetings with him I realized my prayers were answered. Once you have been charged with a criminal offence, guilt or innocence is not a factor in how your case is resolved. The judge & the prosecution will treat you as a criminal regardless of whether you did the crime or not. The American legal system is adversarial and like a sporting event, where two sides are in direct competition, both groups are fighting for a win – you verses the judicial system. Their goal is to convict you of a crime regardless of the actual events that transpired – reality is not mandatory nor is it a factor. Until you get to trial, the only one who will assume your innocence is your attorney. The judge will restrict your rights to the point of imprisonment or setting draconian limits on your freedoms, based only on the charge of guilt. The prosecution assumes you are guilty and will use all available means to intimidate you into confessing your guilt – AKA Plea Bargain. These are the facts of the system you are facing. Having recently gone through this ordeal I wish to share the following insight on this subject.
Once charged with a criminal offence, choosing an attorney is one of the many tasks that must be done if one wants real justice as provided in the U.S. Constitution – without an attorney you will be convicted as charged if for no other reason than protocol. When looking for an attorney one of the daunting chores is wading through the vast number of attorneys available along with the lack of ways to rate their honesty, ability, or the dedication they may give your individual case. Based on my experience (asking friends, family and searching the internet) the specifically sincere reviews of previous clients on the internet were the primary source for my list of candidates. Mark Bennett, based on these reviews, was on top of my list. After a very positive no charge interview Mr. Bennett was the clear choice for me. As such, I wish to give those of you in the same situation a resounding affirmation that Mr. Bennett is “The Man” when it comes to criminal legal representation.
From my experience with Mr. Bennett, I can testify that he is a very personable gentleman who happens to be an honest, direct and extremely knowledgeable attorney. During our first meeting, Mr. Bennett was clear that he would prepare the case for trial and plea bargain was not the goal. He stood his ground during the case and gave excellent counsel on the offers from the Sates. With so many names to choose from, my careful research led to my decision to hire Mark W. Bennett. It was the best decision I could have made. My case was a high-profile, difficult one, taking twists and turns unforeseen by me. The media became involved and in addition, my professional licensing and career was on the line. Unfortunately sometimes lawyers even need to hire other lawyers to defend themselves. Mark is definitely a "lawyer's lawyer", which is the highest compliment in my book to any lawyer, because if you can successfully represent, defend and maintain the respect of another "know-it-all-lawyer", you have achieved a certain level of excellence in professional competence and courtesy.
In my opinion Mark went far beyond his duty to defend me as his client and was able to get the charges dismissed before trial. He was very responsive and communicative, even to my sometimes "dumb" questions. He didn't just assume that I knew the law, he explained it to me, listened to me and kept me centered in a non-condescending manner (even when I was "beating a dead horse to death" or diverging onto paths unknown or irrelevant).

Mark stuck with me for almost five years, he was always straight forward and never lied to me. Mark is one of the most honest and trustworthy lawyers i have had the privilege to know. I had two lawyers before i hired Mark, the other lawyers could not just handle the type of case i was dealing with and one just kept trying to get more money out of me. Mark stuck with me on my case for over a year. Not once did he try to get me to accept a "deal" from the d.a. He even convinced me not accept an offer, all the while he is traveling to conroe once a month, every month for the courts' circus act. In this case you get what you pay for. I can't tell you how many poor bastards I saw getting sold down the river by their $1500 lawyers. I will be keeping Marks card in my wallet for a long time.

After being charged with my first offense (Interfering with Duties of a Police Officer), I searched avvo.com and other websites to find a lawyer. I ended up hired Mark Bennett as my lawyer after interviewing with four other lawyers- no easy task for someone trying to come away with a clean record and minimal legal damage. I chose Mark because he blew me away with his impressive knowledge of the law and because he seemed genuinely interested in helping me win my case. Although his rates aren't as cheap as other lawyers, he will let you the know all of his fee rates upfront without any funny games. I also must applaud him for his quick response times (e-mail and phone). Even if I was not able to reach him, I would get a response back within 20 minutes. The result? When my husband found himself on the other side of the law with felony possession of a controlled substance, we weren’t short in flyers and letters we received from various law firms. I found Mark here and after all the great reviews I was confident that he would be the one to help us, and he by far met the expectations that I had for him. My son (16yrs) was accused of rape by the parents of a girl (15yrs), who he had consensual sex with... Not knowing what to do, who to call....I was lucky enough to find Mark Bennett. If you ever find yourself or a loved one facing charges (misdemeanor or felony/state or federal) call Mark Bennett.
When I found myself in the above mentioned situation, I spent hours researching lawyers online. Mr. Bennett's name kept coming up. I read all the reviews here and then I looked at his website. Frankly, I wish I had visited his website before because he offers the best legal advice anyone can take for free.
So, when you find yourself or someone you love under arrest, try to be calm, tell the person under arrest to also remain calm, and contact Mark. Do not spend hours obsessing over why the situation happened or how it could have been different. The best thing you can do is arm yourself with the best attorney you can find and I believe Mr. Bennett fits the bill.

You never think about hiring a defense attorney. Then a situation occurs in which you must get legal representation. So, instead of obsessing about how this happened or what could have happened differently...you need to calm down and research local attorneys.
Mr. Bennett's name was one of the first to come up after an online search (and hours of the above mentioned obsessing). Please read the reviews of previous clients. His reputation speaks for itself.
Compared to others, the charges my partner faced were rather mundane but no less serious. I knew that if these charges held, it could harm future employment/business opportunities.
After calling Mr. Bennett (you speak directly to him and not a secretary), we set up an appointment and discussed the case. He explained all options and we felt he was a great advocate and the best chance for success.
Dealing with the Harris County justice system was a slow and sometimes frustrating process and Mr. Bennett kept us informed/tried to decrease our anxiety.

Mark recently defended me in a Federal Criminal Case. I have worked with many Lawyers in the past on Criminal and Non-Criminal issues; for myself and other friends and family. I was shocked and frustrated recently when I tried to find a criminal lawyer after being arrested for a Class C misdemeanor. As though spending even one minute in the city jail was not punishment enough, none of the attorneys I contacted would speak directly to me, even though I was actively trying to pay them money to represent me. Instead, I was forced to try to explain my worries and concerns regarding my case to receptionists and legal assistants, all of whom were dismissive and obviously did not care. With my impending court date fast approaching and still without the benefit of speaking to an actual lawyer, I was lucky to locate Mr. Bennett's contact information on the internet. Mr. Bennett is a great lawyer. I would recommend him to anyone who doesn't want to risk losing their case. Very intelligent, knowledgeable, and well known, I was confident in his ability right away. I hired Mark to represent me on a Felon in possession of a weapon charge. This guy was very good. He was always on top of things invovling my case. This guy plays no games. Mark would always talk to prosecutors anytime we went into the courtroom together. Mark gathered all proper evidence on behalf of my case and then put it into a package and sent it directly to the Grand Jury. The Grand Jury NO-BILLED my case. I did not even have to go back to court. I only had two court dates with this guy. He really impressed me. It is like the case never even existed. I was also on parole so I was very nervous. Mark even referred me to a very good parole attorney. I was so nervous thinking I was going to go to trial. Two Police officers word against mine. You know how that is. Mark got this thing taken care of without even having to go to trial. Like I said the Grand Jury gave me a NO-BILL. They would not even pursue the case. Mark Bennett accepted our case even without having the opportunity for a face to face meeting as we were residing in another state.
Mark quickly mapped out a course of action and received a needed delay in our court date.
In the courtroom Mark knew all of the key players. He was well prepared. When asked for critical though difficult to obtain documents he produced them immediately.
From our vantage point Mark's life is built around "defending people". As we all know in life people make mistakes. The legal system can then suck them up and threaten them with severe penalties.
It seems law enforcement personnel, once they independently decide that you are guilty, then vigorously launch a pursuit. Their threats, as in our case, can be very scarry.

I was falsely accused of a crime last year. I knew I would have to go head to head with the arresting officers, so I called Mark Bennett. Mark tore the case apart, creatively gathering evidence that proved that the officers were in the wrong. I was very nervous about going to trial, but Mark reassured me every time I spoke to him. He was always available to me. At every reset, Mark discussed points of the case with the prosecutors, giving them hints about the defense he was preparing. Finally on my court date, the prosecutor dismissed for lack of evidence. Whew! No trial! Mark’s associates got me out of jail quickly, won ancillary cases, and dug through records and witnesses to gather the evidence we needed to prevail. I would, without a doubt or hesitation, recommend Mr. Bennett. He is an outstanding criminal defense attorney. Mr. Bennett has represented several family members in criminal and family law cases. He is impeccable. We first came to use Mr. Bennett is a family law matter following the birth of my granddaughter. He petitioned the court for support and visitation. Since that time, we have returned to court to obtain back child support and considered modification as the child gets older. At the time, my granddaughter was 2 yrs old. She is now 12. The attorneys we have consulted with, since Mr. Bennett’s primary practice now is in criminal law, have all commented on how wonderfully prepared the petition was. When we appeared before the Judge on the back child support issues, years later, even she commented on well preparated the original court orders were. On several other instances, Mr. Bennett has represented friends and family members in criminal cases. The most recent wherein the defendant was arrested and pleaded guilty so that his girlfriend and children would not be affected. The officer himself believed that the defendant was innocent but because of a plea of guilt, Mr. Bennett had to fight hard to prevent this young man from spending many many years in prison. Ultimately, the end result was the defendant was sentenced to very little, to no time in jail. Mr. Bennett fought tooth and nail and even convinced the DA to discuss this matter on his cell phone with the defendant’s mother. I have never heard or seen such a thing. Then in another instance, Mr. Bennett represented a defendant I referred to him in a child molestation case. Because the family members of the child were so convinced that the child and her mother had lied, again, Mr. Bennett fought this case to the end. He was able to prove that the child had lied and the case was ultimately dismissed before even reaching a courtroom. Mr. Bennett has proven his skills and knowledge of the law to my friends and family. We are very grateful for all his hard work and dedication.

Mr. Bennett represented my brother in a federal case that was very trying and emotionally exhausting. He was extremly trusthworthy from the very first meeting and in the course of a year, during which the case was ongoing, he never failed to return a phone call on a timely basis (heck..usually always called back within 30 minutes). I personally reviewed several lawyers in the last 6 years. I met with a little over 6 after researching the best of the best. Defense was my most concern, price was another factor. When it came down to a loved one, price was overlooked. In my first experience with Mr. Bennett, I was impressed from the beginning. This particular case was very sensitive and the final outcome was what I and our family expected. This was what we prayed for day in and day out.
My second experience came unfortunately only a few months later. I already knew I was in good hands and so did the good lord. My case was not as sensitive as my family members was but, still extremely as important to produce a positive outcome as our previous call for help. My case lasted a few months and final outcome was as I expected as well and was very pleased with Mr. Bennett's service. Lawyer’s Comment:
I appreciate this comment for the lesson it illustrates. Sometimes—as here—clients who got what they wanted at the time get buyer's remorse later and regret the choices that they made. When they do, they often—as here—blame the lawyer.
At the time he chose to plead guilty, this client was happy with the result in his case. I had been paid, as I always am, to investigate the law and the facts and try the case if necessary, but the client chose to reduce his risk of a felony conviction by pleading guilty and taking probation rather than going to trial.
Considering the facts of the case (which I won't go into) that seemed a good choice at the time. A shorter misdemeanor probation might have been a viable option, but it would likely have involved a conviction, and would have remained on his public record forever. Taking felony deferred avoided a conviction and should have allowed him to seal his case from public view five years after successfully completing the probation and staying out of trouble. Had he stayed out of trouble, the judge would likely have terminated his felony deferred adjudication early as well; a two-year felony deferred adjudication could have been over in a year or eight months. It's not uncommon for an accused presented with the option of a shorter misdemeanor probation (with a conviction) and a longer felony deferred adjudication (with no conviction) to choose the longer probation.
Had the client come back to me after pleading guilty and expressed his unhappiness with the choice he had made, I would have done everything possible to undo it. Had he come back to me and asked me to seek early termination, I would have done so.
But he didn't. Instead, he waited more than a year after the case was resolved (not 1-6 months, as the client says above)—after he had chosen to commit another crime, risk revocation of his probation, spend 20 days in jail, and lose any chance of ever getting his record sealed—to complain.
Had I expected this client to go around committing other crimes, I would have strongly advised him strongly to choose to try his case instead of taking probation.
