John and his staff are excellent in every way. They helped me understand what was going on with my case from day 1. Even though I moved out of state during the middle of my case I was emailed everything I needed to know, which was a huge help. When I first met John he explained his methodology to me. Fast forward 4 months to the day of my court case. While waiting in the lobby of the courthouse, multiple lawyers come up to him asking him about papers he published and what he thought about this case or that case. Inside the courtroom everyone knew who he was including the judge and it was apparent he had a good rapport with all of them. John didn't take my case and run with it, he explained to me all of my options, what his thoughts were and asked what my intentions were every step of the was. I couldn't have asked for a better attorney for this case and I ended up getting a not guilty undoubtedly thanks to him.
If you are up in the air about picking an attorney, go talk to him and present your situation. As far as payment is concerned he was worth the money and his office is very good about payment plans. I would definitely recommend John to my closest family and friends and in fact have done so already. I hired Mr. Gioffredi in Feb. of this year for my 2nd DWI. (would have been 2nd) He was able to get it dropped. I am so thankful. A friend of mine talked to her lawyer-friend. This lawyer referred John and said that if it was his second offense then he would go with the best. John is very comfortable and confident. took my retainer to handle some tickets for me and knew from the begining the tickets were issued by a constable and he has done this for long enough that he knew that because a constable issued the citations they were locked in .. no getting out of them the only way to handle these citations was to pay the fine and let them go on my driving record he could have told me that from the very jump and saved me the retainer fee he took and did absolutely nothing for. except tell me the amount of the fines about three months after the fact

Lawyer's Comment: I don't know this person, and I don't understand what her complaint is, but she's obviously unhappy. She's also obviously wrong about several things. 1) There's simply no such thing as fines or citations being "locked in." I have no idea where she got that idea. We can always fight the allegations by a contested trial if the person wants to pay us additional money to do so. That doesn't necessarily mean that we are going to win the trial, or that it makes the best financial sense to have a trial, but the trial option is always available for the client if they tell us that they want a trial. 2) Unless there was something unusual about the citation (i.e. - 120 mph in a school zone), under current procedures we can pretty much ALWAYS keep the citation off of the client's driving record - provided that they pay a probation fee on time and otherwise follow our instructions. I suspect that this person either didn't pay on time or didn't follow our instructions otherwise. 3) Specifically, under current procedures available to us, we can almost always keep a ticket issued by a Dallas CONSTABLE off a defendant's driving record by appealing the case and getting the defendant deferred adjudication at the county court. This procedure has been available for so long and is so successful in achieving an eventual dismissal that we always choose this procedure - unless the client affirmatively states that they want a contested trial instead, and then pays us to do the trial.
If the client is upset that paying a probation fee is the ONLY guaranteed way to keep a Dallas constable - issued citation off of her driving record, we have no control over that, other than to simply explain that to her up front. And we always provide people this information, orally and in writing, before they hire us. It's in our contract. We always tell our clients what to expect when they hire us. I've never taken money from a client if I knew I couldn't help, and I've never taken money from a client and then "done nothing." If this unhappy client, or anyone else believes otherwise, I encourage them to call my office any day, any time, and ask any person on my staff what we can do with a ticket issued by a Dallas county constable. The telephone number is 214-739-4515. No matter when you call, or how many times you call, or who you talk to, you will always get the same truthful answer - every time. Perhaps this person wanted or expected her citations to be dismissed outright. Sometimes we are able to do that, if there is a legal deficiency in the complaint, but most times that doesn't happen, and we tell people all of that up front. We can only follow the legal procedures which are available at any given time. We have no magic wand to simply make tickets mysteriously disappear. Believe me, I wish it were otherwise. If anyone can provide me with such a magic wand, notwithstanding my own doubts about the existence of such wands, I will waive it around so we can all see what happens. In 1981 at the ripe old age of 16, I got my first traffic ticket. Dad said call this guy, it was John Gioffredi. Man I'm glad John was good. Kids under 25 do not need a ticket on their record insurance sky rockets. Gio, if I never said thanks, thanks. So about every other year for some reason I've had to use his services. What I like about John, he cares, he ask me the right questions, listens, gives me options, finds out what I want to do, then he does his best to do what I want. He helps me get what I want. I love it. What more do you want form an atty. If you are considering trusting John to defend you. Trust him, he knows what he is doing, He has the expreince you need, the expreince you want.

John Gioffredi himself has represented me twice to date in a trial setting where the outcome was a not guilty verdict.
The first was initially charged as assault on a public servant (cop) and resisting arrest back in 2003. The basic premise of this case was two cops, one from Dallas and another from Garland, who were both in the same car, what they referred to as a "ride along", tried to accuse me of attempting to break into my own car (wth?) When I started becoming a bit of a smart ass with the officers I ended up spending the night in a Garland jail with a fractured nose that was spewing blood and snot all over the place. Mind you, I was up against two cops with no video evidence of my innocence. They ended up dropping the assault on a public servant charge but proceeded to prosecute me with the resisting arrest charge. I called Gioffredi's office to see if he'd mind sitting down with me for a quick consultation. He agreed to meet me after he was through with court for the day. So I stopped by his office and we discussed the details of the case. He stated that resisting arrest is often little more than a bullshit charge, and that's exactly what it was. Fast forward 1.5 years. In the trial Gioffredi meticulously picked the testimony of both officers to pieces. You really have to see this guy work, it's pretty cool to follow his logic. The jury was convinced by his smooth and easy to digest explanation of the law and how it applied to the case. End result, Not Guilty! When the trial was over and I had my not guilty verdict in hand, Mr. Gioffredi even referred me to another attorney to handle the civil suit over the excessive force that the police officers used. Throughout the years I've used Gioffredi's office numerous times for speeding violations and the like and have had great success. Once I even was given deferred adjudication probation for speeding in Rowlett, violated it by speeding in Rowlett again and was simply given more deferred adjudication probation. I'm telling you, this guy is insanely good at what he does. Skip ahead to February 2009. I got pulled over for what the officers stated was a speeding violation. They said they smelled alcohol on my breath and asked me to get out of the vehicle. As naive as I could be I complied and began to take the field sobriety tests. If you've used Gioffredi for anything before, you'll know this is stupid because I blatantly disregarded the verbiage on the back of his card. Anyway, judging by the video I saw in court, I botched the walk the line test up pretty badly... in fact, instead of turning around I walked the line backward losing balance and using my arms to stabilize myself. From that test alone you'd have sworn I was hammered. I was arrested and transported to Lew Sterret where the officers attempted to get me to submit to more tests... at this point I started referring to the back of Gioffredi's card which I've had to use on numerous occasions for traffic violations. It basically says don't submit to the tests... no tests... no evidence, no evidence means not guilty. They just kept asking me to take more tests and more tests and reading from this checklist type sheet of paper as if they didn't hear or didn't care about me declining to take the tests. I became a bit of a smart ass again and spent the night in jail. I called Gioffredi's office up and arranged to go to trial. My license was suspended for 180 days for refusing to take the breath test or give blood but Gioffredi's office handled getting me an occupational license that would allow me to drive just about anywhere in Texas but only for 12 hours per day. I did get to split the 12 hours up however I wanted, but I had to do this in advance by creating a schedule of when I needed to drive. During the trial Gioffredi pulled out books and written sworn testimony from the cops and again began to pick their testimony to pieces. I used this law firm in 2005 for a traffic violation and when I just tried to renew my license this year (2010) I found that they had NOT taken care of the ticket even though they gave me a pink slip that said it was taken care of. Now I have to fight to get it taken care of, and they are completely unwilling to take care of what I already paid them for! I am a legal secretary and this law firm came highly recommended to me by the attorneys at my firm. Evidently they take care of you if you are an attorney, but otherwise they could care less.

Lawyer's Comment: We are human, and we occasionally make mistakes. When we do, we admit it, and we try to do whatever we can to make things right.
But there was no such mistake in this instance. We promised to handle this client's ticket, which we properly did, but an administrative collection fee of $30 (called an "omni fee") was added as a result of this client allowing the ticket to fall into warrant status prior to hiring us. We immediately posted a bond to lift the warrant, and later handled the ticket itself in court. Unfortunately, there is no legal defense (at least none that I am aware of) to these so called administrative "omni fees". And there certainly isn't a legal defense that could be legitimately pursued for less than the $30 cost to pay the fee itself. These fees aren't criminal in nature, so warrants are never issued for non-payment, but the government will not renew a driver's license until the fee is paid. So they pretty much always get their money - eventually. When we get hired on a ticket that has a $30 omni fee attached to it, we offer to forward the $30 fee to the omni fee collection agency at no charge to our clients if they give us the money to do so. Otherwise we instruct them how to pay the fee on their own. But I certainly don't pay the $30 out of my own pocket, anymore than I would do the jail sentence myself should a client of mine be unfortunate enough to be convicted of a more serious crime. We explained all of this to this client, but she didn't like what we were telling her, and wanted us to pay her $30 omni fee out of my own pocket, which we wouldn't do. We had nothing to do with that fee - there is NEVER anything that we can do with these fees. The client just has to pay them (or not get their driver's license renewed.) We have handled over 80,000 traffic citations since 1985, and in doing so, have never once been cited by the Texas State Bar for professional misconduct. So notwithstanding this client's complaint about having to pay the $30 omni fee before the state would renew her driver's license, we feel that we do a pretty good job on these matters. I am very sorry that the government made her pay them $30 before they would renew her driver's license, but there was absolutely nothing I could do about it. John Gioffredi is simply the best DWI attorney in the DFW area. I was arrested on an alleged DWI. I called a lawyer friend of mine to get a referral to an attorney who was an expert in these matters. Without hesitation, he gave me John's name. He said that he is the lawyer that lawyers go to. Not only is John very experienced, but he is extremely confident in what he is doing. While I took an extended period of time for my case to go to trial, he and his staff stayed in touch with me to update me on where things stood. When my case finally went to court, John was outstanding...outstanding to the point where both the prosecuting attorney AND the judge commended him on his representation. Fortunately, I was rightly found innocent of the charge, but win, lose or draw, I would still wrtie the same. John Gioffredi is the very best DWI/DUI attorney in the DFW metroplex, if not the state. Highly recommend!

I was refered to John by a friend who knows a few lawyers that have used John's services. So I said if other lawyers use John he must be good. I was not disapointed. He was very professional but down to earth. He always made me feel at ease and explained things so I could understand. His office staff was also a pleasure to work with. I would always receive letters with court dates and a follow up phone call a few days prior to the court date. I would refer John to anyone who needed a great lawyer.

After being charged with DWI a few years back, an attorney friend of mine recommended John. He went on to say if he was ever charged with one in Dallas, John is who he would use. To me, this speaks volumes. I found John to be an extremely competent counselor and recommend him highly. Though I hope I am never again in the position to have to use an attorney for a DWI, if it is you in that position, John is your man.

John Gioffredi was phenomenal and I would highly recommend him to anyone looking for legal representation! I went to several different lawyers looking for someone to handle my DWI case. Other lawyers were exorbitantly priced, rude, condescending, knowledgeable and vague about their expectations for my case.
I first called John's office on referral from a friend. His office said he was in trial, but promptly provided me with his cell phone number to reach him. John was able to meet with me the next afternoon and spent more than an hour and a half with me discussing the specifics of my case and the options available to me. He is clearly very experienced and was very patient explaining everything. John was a breath of fresh air after other lawyers had been impossible to get a hold of and shoved me out their door as soon as possible. Given his expertise I expected exorbitantly high fees, but his price was more than fair with no hidden or additional costs! John was very dedicated in resolving my case and came out with an outstanding "not guilty" verdict. John always had a respectful demeanor in court and was easy going on a personal level. He made a brutal process much more bearable. Conversely, I've spoken with several other people who needed legal representation at one time or another and have not yet met one person who was satisfied with their lawyer. Most have terrible horror stories about their experiences and paid thousands of dollars for their disappointment. Don't make the same mistake they did and just settle for any lawyer! Even the people in John's office were outstanding. They helped me out with a few unreasonable requests and were always kind and patient. Every time I called they knew me by name and were familiar with my case. I've since referred John to my close friends who required legal representation. I have other friends who have used his services in the past and all speak very highly of him. I'm convinced that you simply cannot find more experienced, more knowledgeable, more fair and more dedicated representation in Dallas! John Gioffredi is very great! I had met John socially and discussed DUIs and the such with him. I had had one several years ago that I was not pleased about my representation. John gave me advice and it suck with me. Then I unfortunately was stopped by the Dallas DUI squad on Greenville. Following John's advice I was able to get this off my record. Everyone in his firm is polite and helpful. I recommend him to friends all the time and he refers me to other lawyers in other specialties that I need help with. I would make him your first call in case of DUI, tickets, criminal defense, etc. Also if it is something he doesn't do he knows a good lawyer who does.
