Description: Client had been on long-term disability through policy issued by employer for approximately eight years. In 2008, MetLife suddenly made an administrative determination that client was no longer disabled under the terms of the insurance contract and suspended her benefits. We prepared a detailed appeal of the insurer's determination as provided by the Employee Retirement Income Security Act of 1974 (ERISA), citing the deficiencies in the conclusions made by MetLife based on the administrative record. The appeals panel agreed with our position and reinstated client's benefits, including back-payments for the period during which benefits were suspended.
