Description: This is an immigration and criminal defense case. My client was charged with shoplifting several years ago. She received a CWOF, which meant she was placed on 1-year probation and ultimately the case was dismissed after that year. What she didn't know was that - because she was a permanent resident of the U.S. - she was not allowed to leave the country and come back after she took the CWOF. Her lawyer never told her his. When she went to Jamaica with her children, sure enough, she was Denied Admission into the U.S. and immigration proceedings began. I reopened her case in Dedham District Court and filed a Motion to Vacate her Plea on the grounds that she was not properly advised of her immigration rights at the time she entered into the CWOF. Simultaneously, I worked with another attorney to file for Cancellation of Removal from the United States.
