Biography

My name is Scott Klippel. I represent passengers who were found with firearms at TSA passenger security checkpoints in the civil proceedings that TSA initiates against them. These proceedings involve the issuance by TSA of a Notice of Violation which seeks to impose a civil monetary penalty. I am not involved in any defense regarding criminal charges which might have been filed against the passenger.

I started TSA NOV Defense shortly after I left the Transportation Security Administration in April, 2013. I was an attorney with TSA from its inception in 2002 and I was in charge of TSA’s Chief Counsel’s Office Notice of Violation Program from July, 2007 until I left TSA. During that time period, on behalf of TSA, I handled over 4,500 NOV cases through the Informal Conference process.

I graduated from the University of Texas School of Law in 1976. (Hook’em Horns). After law school, I spent 5 years with the Kings County (Brooklyn, NY) District Attorney’s Office; when I left, I was in the Homicide Bureau where I was responsible for trying only murder cases. I was fortunate to be able to return to Austin where I worked for the Texas Prosecutor Council and the Texas Attorney General’s Office. In 1985, I opened my private law office in Austin for the practice of criminal defense. In 2000, I moved to the Washington DC area and worked for the U.S. Department of Justice. Shortly after 9/11 and the creation of the Transportation Security Administration, I joined TSA’s Office of Chief Counsel.

Scott was friendly and courteous. I never do these. But I decided to even after the settlement being done years ago.

Operates in different Country; Don’t ask questions

After initially reaching out to Scott about his services, I was in the process of accepting his representation for my TSA case. I followed up by asking a simple question whether or not my violation would be reported into any database (being that his services only follow the process of you acceptin...g the TSA charges). This was a simple question, but he responded with a copy/paste answer and very offended that I even asked this question. Honestly was shocked by his response and his fragility as a professional attorney. More importantly worth noting, he lives in a different country and facilitates this entire process remotely, overseas. He uses a Skype number that makes it seem as though he is in the U. S. Its worth considering if you want someone overseas handling your case. I am glad I performed due diligence. I quickly found another attorney based in the US that has guaranteed a reduction in my TSA NOV fee and in process.

First, I am very happy that you found another attorney with whom you are happy. The problem with my representing you Trey, is that when we first spoke, I not only explained how you could represent yourself with your TSA Notice of Violation, but I also explained to you that TSA was prohibited from releasing any information about the incident. Because you asked me to send you a PayPal Request for Payment so that you could retain me (while knowing I was not in the US), I don't understand why you are complaining about that issue in your review. After our initial phone conversation, you then wrote me an email again asking if TSA could tell anyone about this case. I wrote you that they could not, as I had explained in our initial phone call. When you asked me the same question again in a subsequent email, it seemed like you weren't listening to what I told you verbally on the phone and didn't read my email. My reply to you was – "Please re-read my e-mail below. If you are not going to read what I send you, I will suggest you find another attorney." I was somewhat surprised after that e-mail to you when you then emailed me back, stating you wanted to retain me. After much thought, I felt it best if you either dealt with TSA directly yourself (as I explained during our phone conversation exactly how you could represent yourself) or find another lawyer. Since my being out of the US didn't pose a problem for you (until you wrote the review), the only thing I can think that upset you was that I refused to take your money and represent you. Usually, people complain that a lawyer took their money and did nothing. Here you are complaining I didn't take your money. Again, I'm glad you found another lawyer who you feel comfortable with and who feels comfortable representing you. I hope you listen carefully to his or her advice and read all correspondence carefully as well.

Scott Klippel Review

I had a very negative experience when I hired Scott to help me with a TSA case. While he is certainly very knowledgeable about these TSA cases, Scott seemed to be spread very thin and was not able to spend much time or attention on my case at all. He seemed interested in helping me before I cut the c...heck but once he was paid the tone of our discussions vastly changed and it was clear he did not care about helping me. I would have saved money paying the TSA fine without hiring Scott as my lawyer. Scott’s fee and my eventual TSA fine was higher than if I just paid the fine myself, without Scott’s “representation.”He was not able to help my situation at all unfortunately.

Updates as of 7/24/19, 5/30, 6/11/19, 6/22/19 - As I stated on May 21, I don't believe that this was posted by a client. It is now over 60 days since I offered a full refund this unhappy "client." I have not heard back, which reinforces my belief that this posting is a troll. May 21, 2019 - It is difficult to respond to an anonymous complaint since I cannot review the file, but I will do my best. First, everyone reading this should be aware that when I am retained, their fee stays in my Trust Account until the case is settled. It is only after the case is settled that I consider my fee earned which means I can transfer the fee to my personal bank account. Thus, it is in both my client's interest and my interest to settle a case as quickly as possible, so it doesn't make sense that, as stated in the above post, "he did not care about helping me." If this post is really from a client, then, before he retained me, he would have received a pre-engagement email from me setting out what the expected settlement with TSA would be and how much could be expected to be saved, even factoring in my fee. In the six years that I have been operating TSA NOV Defense, I have never reached a settlement with TSA that cost a client more money than what I promised in my pre-engagment email. This is the first time I am hearing about this complaint and therefore I am baffled by it. However, if, the person who posted this was really a client, please contact me directly at [email protected] and I will immediately refund your entire fee.
