However, not every category noted is protected under the laws of each state and our federal system. One key to proving discriminatory treatment is to show differential treatment of “similarly situated” employees.

Two typical examples of sexual harassment are: a) quid pro quo, involving an attempted exchange of job benefits for a sexual relationship or favors; b) hostile work environment where the harassment is severe or pervasive and working conditions become hostile and abusive to a reasonable person in the complainant’s circumstances, as well as subjectively to the complainant.

A “wrongful” termination requires an exception to the NJ and PA doctrines of employment “at will.” These doctrines generally provide that in the absence of a contractual commitment, public policy or statutory protection, an employee can be terminated (as well as quit their job) for good, bad or no reason as long as it’s not for an unlawful reason. We consider the likely “real” reason for your firing, whether it is legally actionable and projected costs of suit.

Highly recommended attorney.

I hired Mr. Yakin to represent me in a wrongful termination case against my former employer after receiving terrible counsel from another attorney. Mr. Yakin, while evaluating my case discovered several key defense arguments which the other attorney failed in during which was used to strengthen my ca...se. Great lawyer

Excellent Employment/Labor lawyer

My husband and I listened to you when you first came over to talk with Viola and her two colleagues. We knew then that you are an excellent attorney. Because of our occupation with IRS, we conversed with hundred attorneys, we know the good, bad, BSs, and the honest and knowledgeable ones. You are th...e latter. Excellent work. You are so right the insurance co nor the employer informed us of the time frame for filling suit. Also,employer told us to file an ERISA claim for S & A. However, S & A is a payroll practice.
