Discrimination 25%

Employment discrimination is prohibited with respect to categories that are “protected” under State or federal law. Examples of protected categories are race, sex, gender, sexual orientation, age, disability and pregnancy. However, not every category noted is protected under the laws of each state and our federal system. One key to proving discriminatory treatment is to show differential treatment of “similarly situated” employees.

Employment and Labor 25%

We litigate meritorious employment claims for plaintiffs in State and federal courts. We consider the term “meritorious” to include: strong claims of liability; adequate damages to be recovered; ruling out of a favorable pre-lawsuit settlement opportunity weighing litigation to seek recovery of losses including any reputation loss, versus moving on with your other career opportunities; facts that inspire a jury to right an injustice and deter repeat offenses.

Sexual Harassment 25%

Two typical examples of sexual harassment are: a) quid pro quo, involving an attempted exchange of job benefits for a sexual relationship or favors; b) hostile work environment where the harassment is severe or pervasive and working conditions become hostile and abusive to a reasonable person in the complainant’s circumstances, as well as subjectively to the complainant.

Wrongful Termination 20%

A “wrongful” termination requires an exception to the NJ and PA doctrines of employment “at will.” These doctrines generally provide that in the absence of a contractual commitment, public policy or statutory protection, an employee can be terminated (as well as quit their job) for good, bad or no reason as long as it’s not for an unlawful reason. We consider the likely “real” reason for your firing, whether it is legally actionable and projected costs of suit.

Employee Benefits 5%

If you have received a proposed severance agreement, we can often help in three respects. First, with the time sensitive decision whether to waive your rights to bring legal action against your employer for anything that has happened up until your execution of the Settlement Agreement and accompanying General Release. Second, whether to try and engage in negotiations with your employer to increase the compensation or benefits.offered. Third, to review the language terms.

My stress level was immediately reduced

After leaving Richards office following my first consultation, I knew I was in the hands of a knowledgeable professional. I was kept informed of every step of my legal process. Richard was available to answer questions or concerns. He often gave me the pros and the cons of success with my case. T...he comfort level I felt with him helped to alleviate stress during the entire case. I highly recommend his services if you feel you were done an injustice. He provided me with an affordable payment plan during my journey. Once you meet him, you will know that you are in good hands. I prayed for justice and Richard was the tool that provided me with that justice!

"I endorse this lawyer. Richard Yaskin is outstanding. I had the privilege of working with him on a civil trial and saw firsthand that he is strategic, highly organized, brilliant in opening, closing, direct, and cross. He's meticulous with pretrial motions and strategy. He has advised me on various matters, which has been enormously valuable. He is great to work with -- highly collegial, unflappable."

Avvo Rating

Our Rating is calculated using information the lawyer has included on their profile in addition to the information we collect from state bar associations and other organizations that license legal professionals. Attorneys who claim their profiles and provide Avvo with more information tend to have a higher rating than those who do not.

What determines Avvo Rating?
  • Experience & background Years licensed, work experience, education
  • Legal community recognition Peer endorsements, associations, awards
  • Legal thought leadership Publications, speaking engagements
  • Discipline Disciplinary information may not be comprehensive, or updated. We recommend that you always check a lawyer's disciplinary status with their respective state bar association before hiring them.
