I hired Heather to assist me in a divorce that had the potential of becoming very sloppy. Heather was extremely knowledgeable and point on with every piece of advice she gave me (whether I wanted to hear it or not). Two years ago, I was in a hotly contested custody battle with my ex, who was represented by an aggressive and unethical lawyer. Needing a good divorce lawyer to defend me, I read favorable reviews of Heather Swann and hired her, which proved to be a mistake. Heather’s advice to me was basically t...o sit on my hands, shut my mouth and do whatever the other side demanded. The opposition subjected me to burdensome interrogatories, unrealistic restrictions, personal insults, many petty complaints and delaying tactics (I learned later on, not from Heather, that this was a legal tactic to try to get me to run out of money) that received no pushback from Heather. When I complained to Heather that we weren’t directing any like demands and complaints towards my ex, her response was that she was unaware of him having done anything to warrant such action and that it’s not a good tactic for me to, “throw stones in a glass house.” Was she even trying? My next lawyer, who saw the divorce through to a successful settlement, had no problem finding multiple violations of the parenting plan made by my ex during the time I was represented by Ms. Swann. Unlike Heather, this attorney fired back at my ex with formal complaints and interrogatories. He was appalled by how Ms. Swann had failed to fight for me. He told me, “You’ve been kicked around for far too long.” I want to also note that it was highly inappropriate for Heather to forward to me personal, unedited emails from the opposing attorney within which that lawyer went out of her way to insult me. Heather did this without offering any defense of me to either the other lawyer or myself. I did notice that Heather was quite chummy with this person, and I got the distinct impression that she (Heather) was reluctant to do anything that might irritate her. As the case dragged on, I increasingly began to suspect my position was being compromised by my attorney’s conflict of interest. In addition to allowing others to insult me, she did not hesitate to do the same. She made it clear that she judged me for being in the personal position that I was in. If my own lawyer won’t defend me, and will cast shame upon me, what am I spending my money on? When I wrote an email to Heather detailing how she had let me down and clearly needed to separate her own opinions from my case and just do her job, she withdraw from my representation. She likely sensed I was about to fire her, but I was a little surprised that this judgmental, opinionated lawyer had such a thin skin. Suffice it to say, I cannot recommend Heather Swann as a legal representative in a contested custody battle.
