When I'm not in the office, or in court, I'm either training for my next Tough Mudder run, practicing my guitar (believe me, I need the practice), or enjoying time with my friends and family.

Karen, I am terribly hurt by this, particularly because I absolutely do care about your situation, and did everything that could be done for you in your case. I spent a great deal of time - both via email and on the phone with you - trying to comfort you and guide you through what was clearly a very significant and emotional time for you. You came to me because you were served with a petition for an anti harassment protection order. Our first appointment was exactly one week before the first scheduled hearing. I told you then and there that I had a scheduling conflict and that I would move the hearing date. My staff and I then began working with you to determine the best response. We decided that live testimony was a better option than a written declaration. You and I exchanged 25 emails between when you hired me, and the date of our hearing. At the hearing itself, the opposing party got to go first, because it was her petition, and her burden of proof. I cross-examined her, and made argument that the petition should be denied because she did not make her case, and the court agreed. I was able to win this case without you having to testify at all. The judge did tell you that further contact would probably result in an anti harassment order being issued. Despite the judge’s warnings, you contacted the opposing party again, and she filed for another protection order. This time you decided not to use my services, and an order was entered against you. Regarding getting the puppy back, as I have also previously explained, what you were asking for is a remedy known as “specific performance.” You filed a case in small claims, where attorneys are not allowed. At the small claims hearing, some months after our case was over, you were awarded your money back for what you paid for the puppy. You then contacted me again after that, and I explained that you had already received everything the courts could give you. Even if there was an argument for specific perfomance before, there wasn’t once you were awarded a money judgment. I told you that I could not do what you wanted, because the law does not provide for getting both the money back AND the puppy. As a dog owner myself, I know how hard that is to accept, and I absolutely never told you to forget about her. I simply said there was nothing that could be done to get her back once you were awarded the money. I am truly sorry for your pain and the loss of the puppy, but I did everything you hired me to do and then some.

I understand your frustration, and your case was a particularly difficult one; all we had was the statements of a juvenile, and no corroborating evidence to use. The problem with using the declarations you providedwas that they mostly contained hearsay statements and other material not properly considered under the rules of evidence. Your case was dismissed for lack of adequate cause, which was a direct result of the CPS investigation contradicting the allegations against the other party. My staff and I put a great deal of time and effort into trying to resolve your case in your favor, including many hours we either waived on your invoices, or simply did not bill for. So while I am sorry that you did not get the result you wanted, I am also mindful of the fact that your most recent hearing with your new counsel - and new evidence that was not available to my office - has yielded similar results. In any event, I wish you and your family well, and hope that you can come to a resolution in your children's best interests soon.
