DEDICATED, DETERMINED & DECENT

When Adam chose to represent me in a complicated & stressful litigation of my brother’s Trust I found myself involved in, I felt from the beginning I was in good hands. He listened patiently to me and treated me with respect and understanding. He was straight forward and honest with me regarding th...e complex, complicated and tough issues of the case. He was able to come up with a strategy and how he would handle each issue. Adam always promptly got back to me when I called him with questions and concerns. He always had my best interests in mind. He updated me and explained to me what was going on every step of the way. I felt relieved and very fortunate when he was able to negotiate a fair and positive resolution for me. I am thankful for Adam’s entire staff, especially his Paralegal, Deborah, for the hard work, patience and kindness shown me during this case. Throughout this process, I was appreciative of Adam’s professionalism, dedication, determination, hard work and his strong passion to bring this case to a positive end result for me. He truly is a competent attorney as well as a kind and decent person. I would certainly recommend him to anyone who needs a dedicated lawyer in a Probate and Trust case.

Sonoma Bar dispute in progress

Debbie (client) To whom it may concern at the Sonoma County State Bar Association of Sonoma County June, 4th 2017 In reference to the complaint sent May 30, 2017 against Adam Eberts of Eberts and Brockway law in Santa Rosa, Ca. the following is my truthful statement about the fraud, theft and... intentional infliction of emotional distress perpetrated by the defendant. On March 13, 2017, I hired Adam Eberts to represent my case against my sister who is the trustee of my parents’ estate worth approx. one million dollars where my sister who lives out of state and works as a paralegal. I live within walking distance from my parents in Santa Rosa, Ca. where I have worked as an EMT/Nurse and served POA for health care providing 24/7 care to my parents uncompensated and to the detriment of my physical and emotional wellbeing as my mother had Alzheimer’s, and was abusive. I experienced two life threatening health issues related to stress once in November of 2016 and the second in January of 2017. After learning my sister, the trustee had emptied my parents’ house, wrote checks to herself for tens of thousands of dollars I was diagnosed 02/01/2017 with Sever recurrent depressant disorder and needed the help of a qualified attorney to lift this burden and help me fight for what my parents expressed in the trust. I paid the $5,000. Retainer and a hearing was already scheduled (the motion was written by another attorney), however, he didn’t specialize in trust probate and this is what prompted the change in my attorney. I requested a full accounting which was never produced, I requested a deposition of my brother in law who was an accessory to moving all items out of my parents’ house without any notice or my participation into two storage units one in my mother’s name and one in the name of Canaday, (my sister and I are the sole heirs). I wanted the $18,000. That my sister wrote a check to herself be returned and that if she didn’t claim compensation for her brief time as the trustee I would not submit a claim for the three years of professional care rendered by me. I asked Adam to request a list of Items the trustee took to Louisiana, gifted, donated and for the storage units to be frozen. None of this was done, Discovery requests were submitted the trustee’s attorney which I assumed my attorney was taking care of timely Adam Eberts did nothing. He filed no paperwork, gave no response to the opposition and requested all correspondence be sent to him which was never shared with me. May 17th with 6 days before the disclosure was due from my side and only 18 days before a hearing Adam Eberts terminated his representation, but not before he writing an eight-page confidential memorandum including a table of contents which was an analysis of my case and options which were in direct contrast from the sales pitch he and his wife Ann Eberts gave during the intake interview when they wanted a retainer, and urging me to drop the case. This is what he justified charging me thousands of dollars for. Since a motion had been filed and a date was on the calendar, I paid the deposit and gave the directions it was very clear what the direction was to be. I approached several attorneys who could not take the case on at such late notice and seemed to be appalled at the actions and inactions of Adam Eberts and his charming wife Ann. I’m also dyslexic which adds an additional degree of difficulty above and beyond everything else and could result in damages in excess a million dollars. Adam charge me thousands of dollars for the memorandum, refused to return my files, and refunded $1,745. of my $5,000. and refused to return the full amount again crippling me from finding representation. I told him I was getting my money back, and I needed it to hire a new attorney. Adam refused and his charming wife yelled, ‘it will just cost you more money, have a nice day'...
