Andrew and staff are the most amazing law firm.
Andrew and staff are the most amazing law firm. My case was actually quite complicated that included: a divorce, charges against domestic violence, an illegal immigration status and a restraining order against my baby. In addition to all of this the father was against my daughter traveling with me outside the country. All possibilities didn't seem favorable to me. Since Andrew and staff took my case in July of 2018 they did the unthinkable and went out of his their way to help me succeed. The first court hearing I was able to be with my daughter full time and without restrictions. They were able to negotiate taking away the restraining order and six months later I was able to travel with my daughter out of the United States. We are now commencing a new life in Mexico, happy. My case is not done yet but they succeeded with stradegy and heart. They have this human touch and sense and you always feel trust and reliability on their part. My family and I love them.

Amazing Attorney
Andrew and his team did an amazing job helping me with my custody case. Andrew is very honest, trustworthy, knowledgeable, dedicated, and sees your case all the way through. I trusted him with my most precious possessions in life, which are my children. The most difficult part of separation the custody battle but Andrew is calm, collective, and conducts himself very professionally while in court, even when you as the client are going through so many emotions his presence gives you a sense of peace. I would recommend him to anyone who needs help because he truly is one of the best Attorneys out there.

Truly grateful client
I was in a nasty custody case. Andrew represented me when my case was already in a bad position. He took over and was able to succeed in doing what most wouldn't even attempt. I speak with 100% confidence when I say that Andrew provided me with the absolute best representation I could have received and would do the same for you. I am so grateful to have been able to have met and worked with Andrew, truly.

Excellent Attorney!
Attorney Andrew Marcellino and his team are extremely dedicated and helpful. My ex is a bully who made up stories to try to get a contempt of court against me. He didn't like the results of our custody case, so he tried to use another method to get what he wanted. Mr. Marcellino seemed to enjoy putting an abusive person in his place. My ex lost the contempt case and I kept my daughter in my custody. I very strongly recommend Mr. Marcellino.

Unprepared, Uninterested, Waste of Money
You will go to Andrew and he will tell you the same spiel he told me and everyone else. He will offer you a flat fee because he does not believe in charging you for every email and every minute, he spends talking to you about your case. And this will sound great, especially if you have been dealing with lawyer fees for years like I had been. Then you will find out the hard way that he is not charging you for time spent on your case because he is not spending time on your case. I have been fighting for 50/50 custody of my daughter for 6 years. It has been a nightmare and I got it in August only to have my ex file to take my daughter to New York City to live. A move away case is extremely hard and after years of representing myself I was not about to take my chances so I found representation with Andrew. He assured me he knew the ins and outs about what would be needed for the case and what the judge “wouldn’t be interested in”. I sent him and email asking numerous questions like, Question 1 : “Should my wife or anyone be prepared to testify, should we go over questions to ask them” answer from Andrew: “no, even if the respondent has witnesses the judge will assume that each of you have people that can testify on your behalf”. What happened on the day of the trial: She had her BF and mother testify and he looked at me like I had three heads and said have your wife and mother go out of the courtroom so we can have them testify. (not prepared) Next question: Should I gather up emails about times she has not followed the court orders and things she’s said about me and done etc… Answer: “The judge will not be interested in emails. Day of trail: I spent the hour I had for recess driving home scrambling to get emails together that I needed. (not prepared) Question 3: Should you prep me for the trial will the judge ask me questions or will you talk on my behalf? Answer:” Unless is a specific question for you I will be doing most of the talking. Day of trial: You will be speaking to the judge. I was so unprepared and most of my faith was in him because anyone that has been in court knows that speaking and trying to remember all of your points and arguments is what you are paying a lawyer to articulate for you. The list goes on. I had my entire family in the courtroom and during the recess every single one of them said you can not let this guy talk on your behalf, he knows nothing, he barely cross examined her witnesses hes fumbling around his notes like hes a first year law student!!! He did not know anything because every time I tried to talk to him about past experiences, he nodded like hes heard it all before and assured me that things were not important. I told him the type of person my ex was and she will have every little thing and she will spew negativity and manipulate the judge again I was assured the judge would not be interested. She talked for 4 HOURS!!! And all the while he was staring at me like I was supposed to help him out. I can not tell you how upsetting it was. After paying Andrew the “set fee” I had one email exchange and one additional meeting with him (the first meeting I got a babysitter went to his office and he had his friend waiting to tell me he had an emergency and could not make it, we had to reschedule) . He literally looked over my response to her declaration and read her declaration, I included emails that I thought would be important but again he was uninterested and that’s the only information he had. A deer in headlights, that is what I got. He talks a good game but what a disappointment. Half way thru the day I had him step down as my lawyer because I knew in my heart that if I still had a fighting chance, he was not going to do any better than me and I had to speak for myself and my daughter. If you are looking for a lawyer please do not waste your time with this guy. You will be left to fend for yourself and out a whole bunch of money.

Response from Andrew Marcellino June 21, 2019
It is always our hope that a case resolves in the manner wished for by the client. Unfortunately, in this instance, we were hired at the very end for a matter that had been ongoing for several years. The review does not accurately represent our interactions with Mr. Konig, nor our preparation for the trial. However, it is correct that after opposing party presented her side of the case, that Mr. Konig terminated our service before we every had the opportunity to represent his side of the case.

"I endorse this lawyer. Santa Clara County has a very tightly knit community of attorneys and we all pretty much know who is who and who is a person we can work with in efficiently and effectively solving the issues in a case. Andy is one of those attorneys. I am always happy to see his name as opposing counsel because I know we will resolve the issues outstanding in the case. He is an avid and passionate advocate for his clients and very much no-nonsense. He will not sugar coat anything to anyone to make money and he will be honest and finalize a case as soon as he can get it finished to save money and time to everyone involved. I am proud to have Andy as a personal friend as well, and I fully recommend him for his honesty, efficiency, zealous advocacy for his clients, and deep sense of humanity. Andy is also recently certified as a family law expert and I never hesitate to consult with him on cases where I think his expertise can help me and he has always generously helped me."

"Andrew Marcellino, or Andy as I know him, is both a trusted colleauge and friend. He is an asset to the legal community. He upholds the highest ethical standards of the legal profession and is an example of excellent legal professionalism I have worked with Andy as opposing counsel and as minor's counsel in many cases with Andy over the last 7 years and counting. I have always found him affable, honest, and easy to work with. I never worry about his candor with me or the court. But he is ever the zealous advocate for his clients without crossing the line into impossible to work with. He never takes his cases personally -- by that I mean we can have a hard fought case together, but once we're outside the conflict, he is a happy, smiling colleague who understands we have a job to do, but doesn't make it about him. I am proud to call Andy colleague and friend"
