Highly Recommended

Attorney Thomas Fleming was recommended to me by a friend of mine to help me with my particular criminal defense case. Not only was he there to help me in every step in court and with the DMV, he was available to talk anytime to answer my questions I had about my situation. Because I was living out o...f state, I had to perform a phone consultation with Tom but could tell that he was caring and seemed to really know his stuff. I am so thankful that I followed my gut instinct and my friends advice to use Tom as his experience was truly made apparent from the beginning. I would recommend Mr. Fleming to anyone who is looking for a great attorney

Possession while Driving. I'm a free man thanks to Tom!

A few months ago I was stopped for speeding and ended up with a charge for possession of controlled substance while driving. Unfortunately I handled my interaction with the police poorly. I was not aware of my rights, and cooperated fully with the officer. Which means that he ended up handcuffing... me and leaving me in the back of his car for an hour while he illegally searched my car. In the police report he lied on no less than six different details of his account, and I found myself with a court date for a misdemeanor. A family friend recommended I contact Tom about my case. I called and left a message, and then proceeded to call five other lawyers to get some quotes and a better sense of what I had in store for me. Tom was traveling in Asia at the time, but called me back only a few hours later, from his cell phone in the Philippines, to discuss my case. Tom offered to take on my case for considerably less than any of the five other lawyers I’d contacted, even though they were all local to the court where the hearings would be held, and Tom ended up having to drive 90 minutes each way, twice, for 8:30am hearings. But, while the fee was incredibly reasonable, the real joy of working with Tom was… well, it was Tom himself. I had almost no experience with lawyers and the ‘justice’ system, and I feel deeply lucky to have been guided through this process with someone as caring, intelligent, experienced and earnest as Tom. From the very beginning, I felt clearly that Tom was truly on my side. We examined the police report together and saw that I had grounds for a dismissal. While Tom was really clear and thorough about the logistics of what that would look like, he was also very realistic. He said he could clearly tell that the cop had lied and that he was happy to help me try to fight to get the case dropped if I wished. But he also made it clear that there was little chance of us winning that way, and left the choice upto me. In the end, since I’m on the verge of many months of international travel for work, I chose to move forward and do whatever we could to just get through the whole process as smoothly as possible and get it behind me so I could get on with my life. Which is exactly what happened. I met Tom at his office, talked through the whole case, and decided on a plan of action. Tom also coached me on my rights when getting stopped by the police, even role playing the officer with me to help me understand what I could have said to avoid having my car searched. I wish I’d had the coaching before all this happened, and have been sharing this video with everyone I know (Ten Rules For Dealing With The Police: http://www.thomasfleminglaw.com/#blog). Long story short, I’m a free man. Tom developed a strong relationship with the DA and managed to strike a deal for me that was better than I ever could have hoped for. He handled my first pre-hearing without me having to show up. Then for the hearing I was required to attend, but from the time I got through security in the courthouse, I was back out the door in literally less than ten minutes. The end result – pure gold! 20 hours of community service. No fees, no classes, no drug counseling. All I have to do is not get arrested for 12 months and the entire case gets dismissed. After we left the courthouse we had a celebratory lunch where I got to hear Tom recount stories of some of the amazing cases he’s handled over the years, a real treat to get the inside story from such an experienced and talented man. In the courtroom I felt sad for the young men sitting and waiting for their chance to go up, with the public defender hopefully working to really help them. I walked in and was seen within three minutes, signed on the dotted line, and walked out to celebrate my freedom. I wish everyone in a similar situation could be lucky enough to have Tom Fleming at their side.

Highly recommended

I retained Atty. Thomas Flemming to help me with my DUI situation this past year, 2014. He was amazing to work with. Very Knowledgeable and trustworthy when it came to his actions as an attorney. As difficult and challenging my case was, I'm so fortunate that Atty. Flemming was more than just hi...s words and delivered through his actions. With his busy schedule, at times I'd have to leave messages through voicemail or text, but he always made sure that he contacted me as soon as he was available. And during the stressful time, he was able to keep me informed on where we were at with my case and what our next steps were going to be. Overall Atty. Thomas Flemming has helped me through my case, as stressful as it may have been. I'm very happy with the outcome and felt my best interest was always a priority to him. I would highly recommend his services to those that want to have an attorney by their side that is genuinely concerned of their well-being.

"Attorney Fleming is a true counselor of law. His grasp of DUI law, procedure, science, and trial tactics make him the go to lawyer in Contra Costa County for your DUI issues both criminally and administratively for DMV purposes. Attorney Fleming was my professor of trial tactics in law school and it was my pleasure and extreme luck to have learned from him and to have been exposed to his experience, intellect, and legal knowledge. For criminal law matters Attorney Tom Fleming has over 20 years of experience in negotiating terrific dispositions through settlement and if necessary being more knowledgeable and experienced than the opposition for purposes of winning at trial. You can do no better than Lawyer Tom Fleming. I heartily endorse this attorney."

Avvo Rating

Our Rating is calculated using information the lawyer has included on their profile in addition to the information we collect from state bar associations and other organizations that license legal professionals. Attorneys who claim their profiles and provide Avvo with more information tend to have a higher rating than those who do not.

What determines Avvo Rating?
  • Experience & background Years licensed, work experience, education
  • Legal community recognition Peer endorsements, associations, awards
  • Legal thought leadership Publications, speaking engagements
  • Discipline Disciplinary information may not be comprehensive, or updated. We recommend that you always check a lawyer's disciplinary status with their respective state bar association before hiring them.
