Mr. Perea has successfully defended over 50 social workers, law enforcement officers, medical professionals, and public agencies against claims of Constitutional Rights violations including claims arising from the First, Fourth, Eighth and Fourteenth Amendments. He has defended claims asserted by parents suspected of abuse, children placed into protective custody and examined by healthcare officials, as well as inmates claiming unlawful confinement and jail conditions.
Mr. Perea is one of a very small, select group of lawyers well-versed in handling lawsuits arising from the placement of children into protective custody and alleged injuries sustained by children in foster care. His work with social workers and public entities has set precedent. He is at the forefront of the developing law surrounding the Constitutional Rights of children and families, and alleged violations of the rights by child welfare and foster agencies. He is also at the forefront of the law surrounding California’s mandated reporting laws, and social worker regulations including reporting and cross-reporting obligations.
Mr. Perea’s work with social workers and public agencies resulted in the seminal case limiting vicarious liability to a public agency for social worker criminal conduct. (Z.V. v. County of Riverside). He has been successful in obtaining dismissals of many cases before trial in both federal and state courts through diligent motion practice and advocation for the client. He has also worked with opposing counsel to resolve cases with dismissals in exchange for waiver of cost when it is apparent the claims for whatever reason no longer have merit.
Mr. Perea has experience handling a wide range of litigation matters for businesses, employers, employees, and individuals, including matters involving the Clean Water Act; Comprehensive Environmental Response, Compensation and Liability Act (CERCLA); California Real Estate Settlement Procedure Act; Breach of Contract; Breach of Fiduciary Duty; Premises Liability; Product Liability; Negligent Hiring; Negligent Supervision; Breach of Non-Disclosure Agreement; Magnussen-Moss Warranty Act; Song-Beverly Act; Unlawful Detainer; Breach of Commercial Lease; Interference with Business Contract; Interference with Prospective Economic Advantage; Elder Abuse; Invasion of Privacy; Defamation of Character; Dental Malpractice; Catastrophic Automobile Accidents; Catastrophic Brain Injuries; Bivens claims.
Mr. Perea is admitted to practice every state Court in California, as well as the federal district courts of the Southern, Central, Northern, and Eastern Districts of California. He is licensed with the the 9th Circuit Court of Appeals, and the United States Court of Appeals for Veterans Claims. He is a member of the San Bernardino and Riverside County Bar Associations, and Public Agency Risk Management Association (PARMA). He is a former board member and board chair for The Unforgettables Foundation and received numerous philanthropic awards including the foundations’ Heart Award.
