Smoke and mirrors here.

I would like to share my ultimately disappointing experience with this Elizabeth, and criticize the case selection process that I unfortunately experienced. It is most unfortunate that, after having placed my trust and time in her, my family was abandoned in our most vulnerable time of need. I ini...tially contacted her firm because my wife had suffered, as a result of medical negligence, cardiac arrest while having a c-section. I was advised by her to not discuss the matter with any other firms, to stay in touch to provide updates on the case, and that, once my wife's medical records were available, further legal action could commence. We decided to kept faith, believing that she had our best interest at heart, and thus we followed all her instructions, diligently provided all requested information. In a reversal to her purported hard-working and tireless advocacy mantra, however, in consultation with her partners, she decided to drop us and not take our case. It became evident to us that, because our case would have not provided as much money as she had expected/hoped for, we were dropped. I can understand that you reserve the right to take on cases that will provide you with a target margin- and compensate you for your years of education and practice--after all, you run a business, not a charity. My problem, however, is with your disingenuous tactic to emotionally string somebody along, selling yourself as a faithful and indefatigable advocate, just to buy enough time to see how our medical case paned out, all the while consuming our valuable time.

I am sorry that you are frustrated and upset about the information we communicated to you regarding your wife's potential lawsuit. Clearly, at the time you contacted us, you and your wife had been through a terrifying experience. Unfortunately, because of California laws, medical malpractice cases are very difficult and expensive to pursue even for well trained, experienced and accomplished attorneys. At no cost to your family, this is what we did before concluding we were unable to file a lawsuit on your family's behalf: 1. An experienced attorney reviewed all of your voluminous medical records. 2. The records were then reviewed by an experienced board certified physician. 3. Medical research was conducted and cross referenced with the information from the records. 4. Multiple discussions were had with you, seeking additional and updated information and ultimately explaining why we couldn't represent your spouse. 5. We recommended you consult other attorneys to get a second opinion about your potential lawsuit, to see if their analysis was different than ours. We worked very hard to analyze your potential lawsuit before concluding we could not help you. This decision is not one we made lightly. This information was performed as quickly and competently as possible, and communicated to you many months before the deadline in which you are required to file a lawsuit. We understand your frustration and we regret that we cannot be of further assistance to you. Worse than the news that we cannot now help you would be the frustration and loss if we naively plowed forward into extensive and stressful litigation, only to lose the case years from now.
