Replied last April 06, 2015Unfortunately this client made some very poor choices in his personal life that negatively affected his case. Not surprisingly, those poor choices were not addressed by the client in his review above. Although the client was straightforward with these issues at least to us, those circumstances certainly did not exist when the client retained our services, and they were not brought up to counsel until shortly before trial. We tell our clients that they have the God-given right to self-implode in their own personal lives, but the best we as attorneys can do is to minimize the damage if those poor choices affect the client’s case. Arizona prefers joint custody and essentially equal parenting time for both parents. If you are not awarded joint custody and equal parenting time by the court, it either means that there are circumstances beyond your control to facilitate such an arrangement (such as living out of state), OR that you need to reevaluate your ability and fitness as a parent. The opposing party’s “transgressions” cited above were too far removed in time to have been relevant at trial. But unfortunately for this client, his actions were very recent and weighed heavily in the judge’s decision.

Replied last May 09, 2014This review could not be further from the truth. In actuality, the client and I prepared for the hearing together. The client approved the argument and the judge agreed with us, ruling in favor of our client. At the last minute, however, the opposing party brought a very crucial piece of evidence to the judge’s attention—the very piece of evidence our client claimed not to have been in existence. After the reviewing this piece of evidence, the judge instead ruled in favor of the opposing party. Had our client not lied to us, she might have gotten a different result. And when a client writes a negative review claiming that her lawyer sat there and “said nothing”, what that really means is that the lawyer was so irate that his client lied through her teeth throughout the entire representation. To summarize, in order to be successful in a relocation case, you should not lie to your lawyer, withhold crucial evidence, and profess your “knowledge” of the law when in fact you have no clue what you are talking about. Case in point: after the hearing, this client retained another lawyer for trial. As one might imagine, our former client lost at trial with her new lawyer. I guess this client’s knowledge of Arizona law really came in handy.
