"Estate" is the legal term used to define your property and money—basically, everything that belongs to you. Estate planning attorneys tell you different strategies you can use to transfer your belongings after you die. By planning your estate, you can maximize its value by minimizing taxes and eliminating court costs and interference. Estate planning attorneys also help you control and protect your estate during your lifetime, by writing documents that allow you to transfer property and money t

  2. Elder law
    25%
Elder law attorneys and elder care lawyers deal with issues related to elderly and disabled people. They write wills, answer tax questions, and plan strategies for obtaining disability, Social Security, Medicaid, and Medicare payments. Their services are useful for health and long-term care planning, as well as end-of-life planning decisions and instances of elder abuse. Elder law attorneys know what public and private resources may be available for your elderly relatives or for anyone else you

Guardianship and Conservatorship law in Utah allows for a responsible adult to legally manage the affairs of an incapacitated adult who needs assistance for their own safety.

  4. Trusts
    10%
A trust is an arrangement whereby someone owns and manages money or property for another person's benefit. Like a guardianship, a trustee has decision-making authority over the trust property, but no court is involved in the trustee's action–the person who creates the trust defines the scope of the trustee's power. There are many different trust types, including probate trusts, income trusts, spendthrift trusts, and educational trusts.

Limited Liability Company formations are a regular part of asset protection and estate planning. In that context, I form LLCs frequently to protect assets from creditors and simply the management of complex assets including vacation homes & rentals.

My practice focuses on estate planning designed to avoid disqualification of families for the benefit provided to wartime vets who have long-term care needs at home, assisted living facilities, or nursing homes (also known as VA "Aid & Attendance").

  7. Power of attorney

Power of Attorney laws (or the law of agency) allows an individual to appoint someone to handle their financial and even medical affairs if they are unable to handle them on their own. A power of attorney is the legal document designed for this.

  8. Probate
    5%
Probate is the legal process used to carry out a person's will after their death; a probate attorney advises you on how to perform the steps in the process. If a person has no will, the laws of the state specify how property is to be distributed.

A written will lets you decide what happens to your money and property after you die, while a living will lets you decide whether or not you wish to be placed on a medical life support system if you become disabled or incapacitated. Wills attorneys and living wills attorneys know all of the language that must be included in your will documents so that things happen the way you want.

Attorney RobRoy Platt's estate planning practice focuses on helping families enhance their lives today and secure their futures tomorrow. He derives great satisfaction from guiding his clients through the often confusing maze of financial and legal decisions to create plans that ensure the well-being of their families and the accomplishment of cherished family goals. His legal expertise includes family protection, wealth preservation, and values-based planning, as well as planning strategies for divorced individuals. Whether you are married or single, with a traditional family or a blended one, just starting out or looking back on a life well-lived, RobRoy will help you craft a plan that achieves your goals for your loved ones today and for years to come.

While studying law at the University of Arizona in Tucson, RobRoy served as a probate law clerk in the Superior Court of Arizona. There, he observed on a daily basis the frustration and delay that families commonly encounter when forced to work through state court systems to handle even routine legal matters that might have been avoided through proper estate planning. Additionally, RobRoy has personally experienced the frustration that can result from the traditional (and what he considers broken) estate planning model that far too many attorneys currently employ. As he watched his own parents deal with the devastating effects of Alzheimer's-like dementia in his father, it became all too clear that the "estate planning" done by their attorney was little more than one-size-fits-all legal form production. Family wealth preservation can, and must be, much more than that.

With this background, RobRoy became highly motivated to search for and implement a truly effective model for preserving family monetary and values-based wealth upon the incapacitation or death of loved ones. Over time, RobRoy has adopted unique methods of family wealth planning designed to operate smoothly, effectively - and wherever possible - outside of the public court systems, thus maintaining the privacy and efficiency of family wealth transfers that should exist during these times of greatest vulnerability for families.

RobRoy is a member of Wealth Counsel, the State Bar of Utah, the Utah Valley Estate Planning Council, and the Estate Planning Section of the Utah Bar.  He also currently serves as the Chairperson of the Utah Bar Elder Law Section, and is the Chair-elect of  the Solo, Small Firm, and Rural Practice Section of the Utah Bar.

RobRoy regularly provides educational presentations on a variety of estate planning topics including Emergency Legal Planning for Families with Minor Children, Advance Health Care Directives, Veterans Benefits Planning, and other related topics. RobRoy limits his law practice to estate planning and related matters because he is passionate about helping families create happy and secure futures.

Great Attorney!
RobRoy Platt is so calming during a crisis, so well-informed about not just Utah law, but laws in other states. He even research the other lawyer in my situation and informed me as to what he learned about him. He did not force me into a decision, but gave me such good factual information that I was able, with his help, to make my own decision, which is such a great feeling! I have never had an attorney this good, and I have had a few for various reasons. I believe RobRoy is an attorney because he truly cares about his clients! I will never look elsewhere, and I give him my highest recommendation.

Fantastic Attorney
RobRoy and his firm were great to work with. Rather than handing me a pile of boilerplate forms to fill out, RobRoy explained how estate plans, probate, wills, trusts worked and gave me options and recommendations for my circumstances. He fosters a long-term relationship that lends itself well to my changing needs rather than filling out a simple will that neither of us will look at again. His fees are reasonable and definitely worth the value of the service. RobRoy's staff is very professional and on top of my estate plan. I look forward to working with RobRoy for years to come.

Fast and Thorough Communication
My husband and I had Platt Law help us update the trust we had done 5 years earlier. They found that our home title was not included in the trust and we definitely wanted that asset to be included. The homeowner's insurance company sent me a questionnaire about the changes we were making. Being confused by that darn legalese, I wanted to make sure I was filling it out correctly. So I quickly called Patti, Platt Law's Client Services Director, to read through the questions with her. She answered my questions as best she could, but then promised to have Melissa, another of the firm's attorneys, call me back to verify the answers and go over any other questions I had. It was such a relief to have an expert calling me back saying she was happy to help me with anything I needed. She explained the terms and told me which boxes to check. It was a relief to get that kind of quick and personal attention to my details. I would recommend Platt Law to anyone. If they can’t help you themselves, they will get someone who can right away! I just love their guts!

Caring and Thoughtful Attorney
RobRoy helped us through the very difficult and sensitive process of naming guardians for our minor children. We were completely unaware of the serious repercussions of naming the wrong guardians, or of not naming any guardians at all. Each of us came away feeling that our concerns and values had been addressed and appreciated. We are so much more at ease now when we leave the children for any extended period of time. I would highly recommend RobRoy because of the way he connects with, and shows genuine concern for, each individual.
