Nathan Gerald Osborn

Nathan G. Osborn is an Equity Shareholder with Montgomery Little & Soran. His practice is focused on real estate litigation, real estate transactions, and commercial litigation. In addition to his work for clients, Mr. Osborn can be hired as an expert witness or as a mediator in cases involving real estate issues. He is licensed to practice in Colorado and Nebraska.

Mr. Osborn effectively uses his significant trial experience to help transactional clients avoid situations that often end up in court. Similarly, his extensive transactional experience provides valuable expertise when litigating issues arising from transactions.

Mr. Osborn represents a broad mix of clients but primarily handles matters relating to real estate title and access disputes, title insurance, boundary disputes, landlord-tenant disputes, leases, foreclosures, title agent negligence, liens, easements, real estate purchases and sales, real estate development, real estate operating agreements, condominium conversions, real covenants, spurious liens, partitions, zoning appeals, business formation, private and inverse condemnations, treasurer deeds, contracts, defending bad faith allegations against title insurance companies, adversary proceedings/creditor representation in bankruptcy matters, attorney fee disputes, defamation matters, and real estate broker license complaint cases.

Mr. Osborn is a trial attorney and has tried 54 cases including:

- Representing a national title insurance underwriter in a breach of contract case
- Defending a real estate broker in a license complaint matter
- Defending a lender in a fraud lawsuit
- Representing a homeowners’ association and individual residents in an access dispute
- Defending a borrower in a deficiency lawsuit
- Defending a land developer in a brokerage commission lawsuit
- Defending a client in a landlord-tenant dispute
- Representing a business owner in a breach of promissory note matter
- Representing a condominium association in a construction defect lawsuit
- Representing a business investor in an arbitration involving extensive misappropriation
- Representing a real estate holding company in a lease dispute
- Defending a business owner against a trust fund violation claim
- Representing a farmer in a land installment contract dispute
- Representing a mountain property owner in an action to confirm an express easement right
- Defending a property owner in a constructive trust claim
- Representing the holder of a promissory note and deed of trust in a judicial foreclosure action
- Defending a property owner in a boundary dispute.

Mr. Osborn received the highest “AV Preeminent” rating from Martindale Hubbell in 2014 and has maintained this prestigious rating since then. Mr. Osborn was also recognized as a 2018, 2019, 2020 and 2021 Super Lawyers - Rising Star, an honor given to less than 2.5% of lawyers in Colorado. 

Mr. Osborn volunteers as a basketball coach. He is also a published author and sought after speaker.
