I represented a homeowners’ association and individual homeowners in a property access dispute. The case dealt with the historic access rights of a 140 member homeowner association, connecting neighbo ... rhood roads to county roads. After a five day trial, the trial court granted implied easements to the property owners based on adverse use and prescription, implementing evidence of a prior “attempted but imperfect grant,” and estoppel. The trial court also found that parts of the disputed roads were public roads.
