I had a consultation call with Leonard R. Higdon about a legal malpractice case I’m considering against the law office that handled my divorce. He spent over 30 minutes with me on the phone, walking me through the challenges of these kinds of cases and giving me a deeper understanding of what it woul...d take to succeed. He explained things I hadn’t realized—like how some mistakes fall on the judge rather than the attorney, and how certain rulings could have been appealed under Rule 59 or Rule 60 (I hadn’t even known that was possible). He also helped me better understand the “but for” requirement and how proving it is more complex than it might seem on the surface. What makes this situation worse is that my attorney and I filed an appeal for a different topic based on Rules 59 and 60 and this could have easily been added to that - yet another failure I discovered with my past representation. Even though I ultimately decided not to pursue it right now due to the financial burden, I came away from the call feeling more informed and realistic about my options.
