Over Charged!

To begin, I feel I was misled during consultation. I was told that my case was not complicated and could probably be settled over the phone. My case was drug out for 9 months at $300 an hour for my attorney plus the cost of his paralegal and assistant. In my opinion my attorney was not adequately... prepared at mediation where opposing council was prepared. They had done their homework and ran circles around us. One thing this law firm was good at was charging for everything and anything they could think of without supplying sufficient explanation to what I was being charged for. My 9 month long experience at McNamara Law cost me $17,000 in legal fees and we ended up settling for 33,000 more than expected. Again, because we were not prepared and opposing counsel was. Another thing they do well at this law firm is collect your money. When your $5000 retainer is at the half way mark their pit bull accountant is quick to remind you payment is do. She is not a friendly person nor a pleasure to deal with. Lastly, my emails asking questions about my case were not always answered. These were important questions to me at the time and they were neglected. At $300 an hour I expect my emails to be answered. In summary, I would not recommend McNamara Law Office.

Thank you for your feedback. I wish you had told us directly so we could have responded. The law forbids disclosure of client or case details and we must speculate about who you are, so I will respond generally. We answer every email. Not liking the answer or insisting the law ought not apply does not qualify as unanswered. Likely, this case could have been simple had we not been misled about the facts during the initial consultation. When a client contends the law ought not apply to them and rejects our advice, the case costs more. Ultimately, a settlement agreement was voluntarily signed when trial was an option. We give frank advice and are happy to go to trial if that's what a client wants. Making an agreement and blaming us for the outcome is like declining a mechanic's advice and complaining when the car breaks down. Mediation is a settlement conference. There is no presentation of evidence or questioning of witnesses. Everyone may walk away and have a trial. We are always prepared. Some clients fail to tell us important information we learn at mediation. Withholding information from your lawyer does not mean the lawyer is unprepared. Others think the law does not apply to them and claim the lawyer was unprepared because the mediator tells them the same things the lawyer said from the beginning. The cost increases when we must answer the same questions over and explain why the client qualifies for no exemption from the law. If a client raises various potential defenses and insists we research them, costs increase. New clients sign a contract in plain English explaining fees. They also receive a multi-page memo explaining how fees are incurred and can be minimized. We issue bills twice monthly. We never charge for billing questions and always respond promptly. The review claims we represented this person for 9 months. About 18 bills were issued. A client may hire a new lawyer anytime, especially if they are unhappy about the representation or the fees. This client apparently remained with us for 9 months, signed a settlement, paid the bills, and then posted an anonymous review without allowing us to directly address the concerns.

Trustworthy and Strong

My mistake was not using Brian from the beginning. I wasted a lot of time with the wrong lawyer which ended up costing me a great deal. Once I realized my previous lawyer was not working for me I consulted with Brian and then switched to him dropping the bad lawyer. Trust your gut and your instincts.... If you think something is wrong it probably is. Hard to know when you have never dealt with legal matter before. Brian did and awesome job and did all the right things to protect me and was tough on the OC causing a quick conclusion to my long ordeal. Thank you Brian McNamara for your help with a difficult situation.
