Did a great job for us

A lengthy process, but we received our discharge. Overall, Nathan did a great job. A couple of hiccups, but I'm sure it happens with these types of cases. Only advice I would give to someone thinking about Chapter 7 or 13 would be to ask lots of questions and follow up constantly. Never assume your c...ase is being worked on.

Our last resort to get some relief, a total nightmare

In our initial meeting with Nathan (2015), my wife and I thought we could get some assistance. Now, I was a contractor for the US gov and my wife self-employed as hair stylist (25+yrs). Since our initial consultation with Nathan, we were truly clear that my wife's income fluctuates each month which w...as documented on the income forms we submitted each month. Our Chapter 13 case after only a few months, is dismissed; and not approved for discharge; stating my wife's income fluctuates? In addition, Nathan advised us to include my wife's home in Missouri, which we were leasing out at the time; to pay that mortgage. So, anyone can imagine this was a complete nightmare for us, we lost our property, ruined our credit. As directed, we paid into the court trustee account every month. Of course, the court trustee approved for Nathan to be paid the $2700 we paid into the account. We did not benefit and had to consult another attorney who said we should not have included the out of state property in our Bankruptcy filing. Especially if we were not profiting and breaking even on that asset. It was crazy. I remember asking Nathan if my wife and I need to attend the additional court hearings and he said no. I should have gone anyway to be there in case the trustee or judge had any questions. It has taken my family (7 years) to rebuild our credit. FINALLY emerging from financial purgatory. To us it was not worth the hassle to file bankruptcy, and still lost our property! We followed every direction given by the court and Nathan; we still saw no relief. We ended up working out settlements with every creditor. We never refiled for bankruptcy and will never ever consider it as an option.

I am sorry to hear that your experience with bankruptcy and my firm was not a good one. Chapter 13 bankruptcy can be very difficult. Millions of people have saved their homes, cars, and eliminated debt in Chapter 13 bankruptcy, but it can be challenging. I remember you and your case. I reviewed your file this morning so I could become better familiar with your situation. I disagree with what you have said here. I am not implying that you are being untruthful. I am simply suggesting that the situation was more complex than you have described in your review and that you are mistaken. As for your wife's real estate in Missouri, earning enough in rent from a tenant to pay the mortgage, taxes, and insurance is not breaking even. What happens when you need to spend $8,000.00 replacing an air conditioner? What happens when the roof needs to be fixed or the water heater replaced? What happens when your tenant moves out and the property is vacant while you look for a new tenant? What happens when your tenant simply stops paying you? If a client comes to me and tells me that they are barely getting by financially and have rental property that is not profitable with no equity, then I advise them to surrender the asset in the bankruptcy case. That is simply good advice. I didn't become a bankruptcy attorney for the money. The truth is that there are many other types of law that are much more profitable. I will never get rich being a bankruptcy attorney. I do this job because I want to help people. I like knowing that I can make my clients' lives better. I am happy for you and your family and that you have finally emerged from financial purgatory. I hope you have much success moving forward.
