Practice areas
  1. Family

  2. Divorce and separation
I can help you with the intricacies of divorce filing, property division, child custody, child support, and alimony. In some cases, a legal separation is a better option. I can help you decide which choice is best for your unique situation.

  3. Uncontested divorce
I can provide as much or as little help you need to help finalize your uncontested divorce as quickly and inexpensively as possible.

  4. Child custody
Feelings can run very high in legal matters involving child custody and your rights as a parent. An experienced representative can help you achieve the most favorable result possible in the best interest of your child.

  5. Adoption
Your family should be well represented to ensure nothing stands between you and the ability to welcome home a new family member. My firm has experience guiding families through the adoption and family planning process.

Tana Benner is an attorney and founder of Benner Law. She has worked exclusively in family law matters for more than a decade. She started her legal career by serving as the court-appointed guardian ad litem in child order-of-protection cases, many involving cases of abuse and neglect. From this experience, she gained an uncommon perspective on the legal issues involving children and the importance of compassionate legal guidance.

From this beginning, Benner has grown her practice to encompass a wide set of legal challenges families face. She focuses especially on adoption law, custody cases, and guardian ad litem work. She represents parents and children in cases of divorce, custody modification, child support, and guardianship cases in probate court.

In law school, Benner was a member of the Missouri Environmental Law & Policy Review and was published in the journal for her note, "Waving Good-Bye to Environmental Laws." She was selected to participate in the Family Violence Clinic at the University of Missouri where she represented victims of domestic violence under the supervision of Professor Mary M. Beck. Currently, she is a member of the Missouri Bar, the Boone County Bar Association, the American Bar Association, Women's Network through the Columbia Chamber of Commerce, and Emerging Professionals in Columbia. She lives in Columbia with her husband, Nicholas, and their son, Cohen.

Claimed Child Support
Hired Tana Benner to modify the child support owed by my child's father. He recently finished his medical residency and started making significantly more money but refused to pay any more than he did before. He kept giving us the runaround about his student loans and cost of living but completely ignored our child's necessities, childcare etc. Tana Benner came in and increased his monthly payments by a lot! He now has to cover not only necessities but also our child's activities as he's getting older. Thank you so much, Tana! I'm so glad I hired you! She explained everything my child was entitled to and got it for us!!

What More Can I Say
Thank you, Tana Benner, I don't think I could have been in a worse position before coming here. I had lost my son, my home, my reputation, and everything important to me. Thanks to Tana Benner I got my son back, my home back, and my life back. Even after my ex filed for two restraining orders, Tana was able to prove them false and baseless. She was able to get this divorce/custody battle on the right track and resolved. My son is doing so much better now and it wouldn't have happened without Tana, and the rest of her team. Thank you!

Uncontested Divorce
I was seeking advice on how to file for an amicable divorce for my parents who had been living apart for over 10 years. One was very ill and it was important to protect both of their assets in the advent of a catastrophic illness. As my parents lived in Columbia and I was almost 200 miles away, finding Tana Benner, who was recommended by my local attorney, was a godsend. We were able to handle all of the particulars electronically via email and Tana helped us divide up all of the assets in a way that way that was fair to both of my parents. Everything was as smooth as possible except for the archaic court system. It took over 5 months to get an uncontested divorce to be accepted by the court. Obviously not her fault, I would wholeheartedly recommend Tana Benner for any matrimonial matters that you may have to deal with.

Glad To Have Met Her
I wish I had met Tana Benner 3 and a half years ago when I had first filed. I would have been divorced by now with her representing me. She is no-nonsense, takes no bs and gets right to work. She comes to court prepared, organized and is responsive to all questions and concerns, while also helping her clients navigate their frustrations. I'm sure everyone going through a divorce knows how emotionally draining these things can get and many attorneys tend to take advantage of clients in that emotional state. Tana Benner! I had really lost all respect and faith in lawyers until I met her. Like I said earlier I hired Tanner Benner in March of this year and in November (same year) I was granted a divorce. STOP YOUR SEARCH AND HIRE HER !!!! you won't be disappointed.

Can't Say Enough
I cannot say enough positive things about Tana Benner of Columbia Family Law Group. Choosing an attorney for a divorce or any legal matter requiring representation is a scary and overwhelming thought. My fears were comforted by the professional, yet reassuring atmosphere in working with Tana. She is prompt, reliable and takes time with her clients. The communication channels were always open and Tana spent the extra time for my concerns to ensure she and I were always on the same page. Tana represented me for 2 different legal matters within the last year, and both cases were handled timely, to my satisfaction with a professional, yet personal touch. My favorite aspect of both of my legal dealings with Tana was the upfront information that she provided me with. In both instances, Tana calmed my fears from the beginning by giving me facts (applicable laws, appropriate processes to adhere to, timelines of completion, etc). Being able to understand the legal process, knowing what the law(s) are and how they apply to you personally and an estimated timeframe took the guessing game and scariness of the "unknown" out of the picture for me and left me a solid foundation out what outcome(s) to expect. As a client, that was extremely important to me, as I do not function well in a world of the unknown! I hope to never have to be represented by an attorney again, however, my first call would be to Tana Benner.

Tana successfully navigated her way through not one, but two adoptions for our family. She was not only professional, but timely and responsive and was extremely empathetic to nervous parents to be who probably called her far too often. I would recommend her without hesitation. Thank you Tana. Tim & Angela

Thoughtful and considerate. Experienced and Engaged
Tana was clearly engaged and understood my situation and my own take on how I felt this should go. She kept me up to date on what to expect and what I needed to do in a thoughtful and concise manner. Tana was able to grasp the complexity and showed very clear understanding that each situation isn't the same as the last. I appreciated her ability to juggle her schedule with mine and kept the situation from becoming hostile.

A real find
I have worked with Tana Benner for eight years. I feel privileged to have found her and to call her my colleague and friend. She pushed through the first same sex divorce in Missouri. She is smart, caring, funny and takes the time to listen to her clients and find out what their needs are. Tana has the same interest that I do which is making sure that our clients are always number one, that we are prepared, professional and that we know that we have done everything possible for each client to have the best possible outcome in their case.

Confidence and Listening
Tana is an active listener and follows through promptly. Her records are comprehensive and delivered in a timely manner. Having hired 2 attorneys previously for two separate family matters, I can say confidently that she was the most comfortable one to work with.

Good for a cut and dry case, but won't fight for you if you've been taken advantage of.
I almost hate to write this review because I really liked Tana; she's very personable and easy to communicate with. I would recommend her for certain types of cases (more routine). If you need someone to deal with an aggressive opponent, I would not recommend her. After living with the outcome of my case for a while now, I question my decision. I had all the facts documented (with proof) when I retained Tana. The other attorney immediately filed outlandish motions and used scare tactics to influence me. I needed an attorney to help me see through the emotions, and take control of my case. Simply put, I initiated my case, which most people considered an "easy" win... but we spent most of the time (and a great deal of money) defending it. Tana didn't "lead" me or my case; she asked regularly what I wanted to do (which I understand has goodness to it), but I needed her to advise me on what to do. I wound up "rolling over" to avoid trial (the scare tactics worked), and now my child's father has virtually disappeared (he doesn't exercise his visitation rights as we agreed to, which I knew would be the case). He's in arrears on child support, despite it being close to half the amount is should have been. I still don't understand how or why my case turned out the way it did.

Response from Tana Benner November 10, 2014
I am sorry to hear you were not satisfied with the outcome of your case. Since the facts of this review do not exactly fit the facts of any recent cases I have had, I encourage you to please identify yourself and contact me directly to discuss what you believe I should have done differently. You bring up some good points. First, if are looking for an attorney to "lead" you down the wrong path, that is not me. Additionally, when dealing with a parent who does not truly wish to have a relationship with the child and does not care about supporting his or her child, the results feel unfair. Unfortunately, there is no motion I can file to change your child's father or the facts of your case. Even if you decided to proceed to trial and if you got a more favorable result, it would not change your child's father and it could have made things worse. In some cases, the best decision is to save yourself the additional attorney fees and heartache that come along with trying to "win." There are no winners in cases involving bad parents.

Going through a divorce is emotionally, mentally and physically the worst thing I’ve went through in my life. You hire a lawyer who is understanding and competent to help you get through this hard time. I received the opposite services. Mrs. Benner was unprepared, not knowledgeable about court procedures and caused more emotional, mental and physical hurt during a time I needed a professional. Between the stress of getting an unwanted divorce and the stress Mrs. Benner caused in the process, I was unable to work and struggled daily. The only reason I was granted anything in my divorce after leaving my ex with everything besides a few belongs that I took for me was because of my mother. My mother put together all documentation for court, researched the law and policies as well as provided all emotional support during the process. I paid Mrs. Benner in full for her “lawyer degree” but would not recommend her to represent you during a horrible time unless you are prepared to feel worse and represent yourself without getting paid.

"I have worked with Tana for over 8 years. She is a colleague and friend. Her accomplishment in obtaining the first same sex divorce in Missouri is something many people don't know about her. She hasn't been afraid to tackle complicated legal issues in front of our judges. She is intelligent, patient, fun to be around, and really cares about her clients. She shares the same goals that I do in terms of always trying to put our clients first and focusing on making sure every client has the best possible outcome in their case.
