I met with him yesterday and told him I had an unsecure loan that I wanted to keep because I work at the financial where the loan is from. He told me there was no way to do this. We are sorry about your experience at our firm. We strike to explain all matters fully so that the client understands the advice that we are giving. I believe, though, that in this case there was a miscommunication. The bankruptcy code requires that all debts be listed - we cannot pick and choose. So, if there is a debt (whether it be dischargeable, nondischargeable, secured, or to a family member), it must be listed. For unsecured debts, there are few (if any) that I would recommend being reaffirmed. Plus, the court will scrutinize the reaffirmation of unsecured debts very carefully and in some instances deny the reaffirmation. I do not recall telling the client that there is no way to keep the loan. For payment plans, again I believe there was a miscommunication. Yes, we do accept payment plans, but for Chapter 7 bankruptcies the full amount needs to be paid before filing whether that is in a lump sum or via several payments. If the full amount is not received prior to filing, the attorney (here us) are now creditors in the bankruptcy which creates a conflict of interest. Any attorney who says that they can take part of the fee before filing and the remainder afterwards is risking a conflict of interest. If the client has further questions or clarifications, I would invite them to contact me directly to discuss this.
