I grew up in Dothan, Alabama and graduated from Auburn University in 1985. I have lived in Nashville since 1986 and I love it! I love to travel, even if it is just to the beach for a long weekend. I like being outdoors and love to take long walks with my labradoodle, Stella, for exercise. I am married to attorney Phillip Miller and we share office space in a beautiful Victorian house on Woodland Street in Nashville...very convenient to the Courthouse, and free parking! Questionable Conduct after Ms. Miller’s Promises of “No More Dog Muzzling and Zealous Representation.”

Michael, you are entitled to your opinion, but you have taken it one step too far by calling me unethical. So, let me set the record straight. You paid a $5,000 retainer to our firm on February 6, 2018. After leaving our representation, your new attorney emailed our office on May 22, 2018, requesting us to send you any unearned retainer. My office emailed your new attorney on May 24, 2018 and told him that I was out of the office on vacation until mid-June and would not be able to process a refund until then. So, after returning to the office, I sent you a statement on June 19, 2018 showing that you were due a refund of unearned fees in the amount of $1,990.50 and asking you to let me know if you had any questions. You didn’t do that. Instead, you filed a fee dispute complaint with the Nashville Bar Association the very next day, on June 20, 2018. Your attorney emailed me on June 27, 2018 stating that you were requesting a copy of your fee agreement. I replied the same day and sent a copy of the fee agreement. So, up to this point, you didn’t even have a clue as to what your retainer agreement said because I never made an issue of it. I was then contacted by your attorney demanding a refund of $4,000 of your $5,000 retainer. I did not agree to that. However, you and I both agreed, in writing, to a refund of $2,500.00 of your retainer, and you were represented by counsel. You signed a Compromise and Settlement Agreement on July 21, 2018 and agreed therein that this was “full and final settlement of any and all claims relating to fees” which you may have against me, my firm, our agents and assigns. Yet here you are, trashing me on the internet. To the readers of this review and response, I ask you this: Who seems like the more ethical of the two of us at this point? Further to the readers of Michael’s review, let me take this opportunity to provide information for a more productive purpose. Michael didn’t leave my/our firm’s representation because I was “unethical”…he left because I sent a snarky email to him and it ticked him off. I get it. In hindsight, I probably should have slept on it before clicking “Send”. But, lawyers are people too. And, because I do this every day and have for 22 years, I sometimes forget that my clients are generally not having their best day when they need my services. Sounds like a no-brainer, doesn’t it? Well, hopefully I’ll remember that the next time I’m about to lose my patience with a client. So, let’s talk about what you do when you are unhappy with your legal representation and you decide to move on to another lawyer. Do you post a review of their services online if you feel the need? Certainly! Reviews are an excellent way to improve a lawyer’s practice and the legal profession in general. I would like to think that reviews can “raise the bar”, no pun intended. But sometimes it is just a matter of not being a good “fit” in the attorney-client relationship. Every lawyer’s style is different and their methods may not resonate with every client. Do you post a negative review online just because your lawyer rubbed you the wrong way or hurt your feelings in an email? That’s up to you. But remember this: the internet is a powerful tool. Posting a review online can have a lasting impact on a lawyer’s livelihood. So, if you find yourself in this position, ask yourself “What is my motive in posting this review? Is it really warranted? Or could I just tell this lawyer to go jump in a lake and move on with my life?” If you decide to post a review, be constructive about it rather than destructive. Remember, your review, positive or negative, will help potential clients decide whether or not to retain that lawyer, which in turn affects that lawyer’s ability to make a living. Being fair about what you say and how you say it isn’t only helpful to the legal community and potential clients, it is just the right thing to do.
