I had a really frustrating experience with this personal injury attorney on a slip and fall case. Communication was a constant problem — calls and emails went unanswered for long stretches, and I was rarely told about changes or updates unless I kept pushing for information. In the end, the case w...as settled for a very low amount, and I didn’t feel like my case was taken seriously or that my best interests were being fought for. The lack of communication and effort just added stress to an already difficult situation. I wouldn’t recommend this attorney if you want someone who keeps you informed and actually works to get fair compensation.

Excessive Fee Questioned And Cautioned By Judge

Attorney provided service for a fee of 25% in my Workers Compensation case. It is becoming increasingly difficult to find a Workers Compensation attorney who will accept a guideline fee of 17.5%. This attorney and another I consulted with, cited the Miles ruling as cause to charge a 25% fee. Ultim...ately, Judge Lorenzen granted an Order Approving Claimant Paid Excess Fee but not before questioning the number of hours Mr. Feldman spent on my case and his time keeping. The below is extracted from such order, entered on 1/12/17. Mr. Feldman's fee data sheet filed contemporaneously with the motion for approval of the 25% fee indicated counsel expended approximately 12 hours in representation. The judge entered an order directing my counsel to file an affidavit of his time to allow the court to determine if the fee in excess of the guideline was reasonable. Mr. Feldman filed his affidavit approximately 4 weeks later. Time records attached to the affidavit appeared to be generated from a computer program and indicated a total of 22 hours. The order reflects surprise that counsel underestimated his time involvement so drastically. Three entries were made for legal research totaling 5.3 hours. None of the claims in the petition were novel, unique or complicated and the court could not understand the repeated charges for legal research. Counsel was cautioned for the future: court expects a time affidavit with every request for excess fee. Court expects the hours in the time affidavit to be reasonably similar to the time shown on the attorney fee data sheet so the court doe not have to question whether counsel is keeping contemporaneous time records or only creating them at the time JCC asks to see them. Also worth noting that I did not receive a reply to at least two of my emails to Mr. Feldman. In one email, I requested Mr. Feldman call me to clarify an issue. He did not call and I was told by his paralegal a few days later that Mr. Feldman is only available to speak with a client by phone when a phone conference is scheduled in advance. Hope you have better luck in securing an attorney that will actually be invested in your case.
